Abstract

ABSTRAK


Penulisan jurnal ini bertujuan untuk memberikan pemahaman mengenai proteksi hukum atas konsumen yang mengonsumsi atau mempergunakan produk kosmetik yang tak terdaftar pada BPOM serta untuk mengetahui sanksi hukum yang akan diterapkan bagi para pemilik usaha kosmetik yang tak terdaftar pada BPOM dan Langkah preventifnya. Melalui metode penelitian hukum yuridis normatif, yang mana penelitian yang dicoba menerapkan metode, mempelajari, serta menelusuri literatur hukum dan menganalisa informasi sekunder semacam aturan Perundang-Undangan serta teori hukum, guna mendapatkan informasi ataupun kebenaran akurat sesuai aturan yang ada agar memperoleh kepastian hukum yang tetap. Perihal tentang proteksi hukum sudah dijelaskan dalam Pasal 19 ayat (1) serta (2) UUPK perihal Tanggung Jawab Pelaku Usaha, sejatinya pengusaha mempunyai kewajiban menyediakan kompensasi kepada konsumen atas kerugian yang diakibatkan karena mengkonsumsi atau menggunakan barang maupun jasa yang diperjualbelikan. Peranan BPOM yakni melaksanakan aktivitas evaluasi serta penyidikan atas pelaku usaha yang nakal. Adapun pelaku usaha yang tak patuh pada aturan bisa dijerat sanksi hukuman berbentuk sanksi administratif serta sanksi pidana.

ABSTRACT


Writing this journal aims to provide an understanding of legal protection for consumers who consume or use cosmetic products that are not registered with BPOM and to find out the lagal sanctions that will be applied to cosmetic business owner who are not registered with BPOM and their preventive steps. Through normative juridical legal research methods, in which research attempts to apply methods, study and explore legal literatur and analyze secondary information such as statutory regulations and legal theory, in order to obtain accurate information or truth in accordance with existing regulations in order to obtain permanent legal certainty. Regarding legal protection, it has been explained in Article 19 paragraphs (1) and (2) of the UUPK regarding Responsibilities of Business Actors, in fact entrepreneurs have the obligation to provide compensation to consumers for losses caused by consuming or using goods or services that are traded. The role of BPOM is to carry out evaluation and investigation activities on unscrupulous business actors. As for business actors who do not comply with the rules can be subject to sanctions in the form of administrative sanctions and criminal sanctions.
