MEKANISME PENGUNDURAN DIRI SUATU NEGARA DARI KEANGGOTAAN ORGANISASI INTERNASIONAL (STUDI KASUS: BRITAIN EXIT)

Abstract

Penelitian dalam artikel ini bertujuan untuk menganalisis pengaturan pengunduran diri keanggotaan suatu negara dalam organisasi regional seperti ASEAN dan EU menurut hukum internasional, serta untuk mengetahui mekanisme pengunduran diri keanggotaan Britania Raya dari EU (Brexit). Melalui jenis penelitian yuridis normatif dengan analisis deskriptif kualitatif memberikan hasil bahwa perbandingan pengaturan pengunduran diri antara ASEAN dengan EU dapat dilihat dari instrumen pokoknya yang mana ASEAN Charter tidak mengatur tentang pengunduran diri negara anggotanya, sedangkan EU dalam Lisbon Treaty telah secara ekspilisit mengatur hal tersebut. Sementara itu, upaya Brexit tidak dapat dikatakan berjalan lancar karena dalam Lisbon Treaty tepatnya Pasal 50 dicantumkan mengenai syarat-syarat yang wajib dipenuhi oleh pihak yang ingin menarik diri dari keanggotaan EU. Kata Kunci: ASEAN, European Union, Pengunduran diri, Brexit ABSTRACT The study in this article aims to analyze membership withdrawal agreement of a country in regional organizations, such as ASEAN and the EU by international law, and to learn about the withdrawal mechanism of the United Kingdom from the EU (Brexit). Through the normatizing judical research with qualitative descriptive analysis it shows that the withdrawal agreements comparison between ASEAN and the EU can be seen from its elective instruments, which ASEAN Charter doesn’t arrange the withdrawal of its member state, whereas the EU in Lisbon Treaty explicity arranged it. However, Brexit’s effort was not successful, since chapter 50 in Lisbon Treaty specifically stated the obligatory requirements for those who wish to withdraw from EU membership. Keywords: ASEAN, European Union, Withdrawal, Brexit.
