Penjatuhan Pidana Pelatihan Kerja Bagi Anak Dalam Hukum Positif Indonesia

Abstract

Tujuan studi ini untuk mengkaji kepastian hukum terkait dengan penegakan hukum berupa pidana pelatihan kerja terhadap anak. Studi ini menggunakan penelitian hukum normative dengan pendekatan peraturan perundang-undangan. Berdasarkan hasil penelitian, dari permasalahan hukum yang diteliti oleh penulis, berkaitan dengan pidana pelatihan kerja dalam kaitannya pada tujuan pemidanaan harus dilihat dalam kerangka teoritis dari restorative justice yang menitikberatkan tidak kepada penghukuman semata atau retributive namun juga pada pemulihan pasca kejahatan terjadi. Selanjutnya berkaitan dengn tinjauan yuridis pengaturan lebih lanjut dari pidana pelatihan kerja kedalam Peraturan pelaksana ternyata masih belum terlaksana sehingga membuat terjadinya kekosongan norma.

ABSTRACT

The purpose of this study is to examine the legal certainty related to law enforcement in the form of criminal work training for children. This study uses normative legal research with the statutory approach. Based on the results of the study, from the legal issues examined by the author, relating to criminal training in relation to criminal objectives must be seen in the theoretical framework of restorative justice which focuses not only on punishment or retributive but also on post-crime recovery occurs. Furthermore, in relation to the juridical review, further regulation of work training crimes into the implementing regulations apparently has not yet been carried out, thus creating a norm of emptiness.
