URGENSI PENCATATAN HASIL KARYA CIPTA TARI SEKAR TUNJUNG SEBAGAI SALAH SATU JENIS TARI PENYAMBUTAN

Abstract

Tujuan studi ini untuk mengetahui bagaimana prosedur atau cara pengajuan permohonan karya cipta tari sekar tunjung guna memperoleh pencatatan ciptaan di Kementrian Hukum dan Hak Asasi Manusia serta bagaimana urgensi perlindungan hak cipta tari sekar tunjung sebagai salah satu jenis tari penyambutan dengan menggunakan metode penelitian hukum normatif berupa pendekatan perundang-undangan dan juga pendekatan konseptual. Adapun pendekatan konseptual yang dimaksud yaitu dengan menelaah peraturan perundang-undangan yang terkait. Hasil studi menunjukkan bahwa tata cara pencatatan karya cipta di Kemenkumham dapat diajukan melalui Direktorat Jenderal Hak Kekayaan Intelektual, juga dapat diajukan melalui Kuasa Hukum Konsultan HKI yang telah terdaftar, serta pemilik karya cipta dapat pula mengajukan karya cipta tari sekar tunjung tersebut ke Kanwil Kemenkumham RI di seluruh Indonesia dengan menyetorkan beberapa hal diantaranya yaitu surat atau formulir pendaftaran disertai dengan melampirkan fotokopi KTP, salinan resmi akta pendirian dari  badan hukum yang telah dilegalkan oleh notaris, melampirkan surat kuasa jika diajukan dengan kuasa, serta wajib membayarkan biaya pendaftaran sesuai dengan aturan yang berlaku. Selain itu, mengenai pendaftaran karya cipta tari sekar tunjung penting dilakukan agar karya cipta tari sekar tunjung memperoleh perlindungan hukum dari adanya palgiarisme atau peniruan yang saat ini sedang marak terjadi.

The purpose of this study is to find out the procedure or method for submitting an application for a copyrighted work for the Sekar Tunjung dance in order to obtain a recording of the creation at the Ministry of Law and Human Rights and how the urgency of copyright protection for the Sekar Tunjung dance as a kind of welcoming dance by using a normative legal research method in the form of an approach legislation as well as a conceptual approach. The conceptual approach in question is by examining the relevant laws and regulations. The results of the study show that the procedure for recording copyrighted works at the Ministry of Law and Human Rights can be submitted through the Directorate General of Intellectual Property Rights, can also be submitted through a registered IPR Consultant Legal Counsel, and the owner of the copyrighted work can also submit the copyrighted work of the Sekar Tunjung dance. to the Regional Offices of the Ministry of Law and Human Rights of the Republic of Indonesia throughout Indonesia by depositing several things including a letter or registration form accompanied by a photocopy of ID card, an official copy of the deed of establishment from a legal entity that has been legalized by a notary, attaching a power of attorney if submitted by proxy, and must pay the registration fee in accordance with applicable regulations. In addition, regarding the registration of copyrighted works of Sekar Tunjung dance, it is important to do so that the copyrighted works of Sekar Tunjung dance obtain legal protection from plagiarism or imitation which is currently rife.
