PROVOCATIVE VICTIMS: SEBUAH BENTUK MERINGANKAN HUKUMAN PIDANA

Abstract

Tujuan studi ini untuk mengkaji provokasi korban atau provocative victims sebagai hal yang dapat dipertimbangkan hakim dalam putusan pemidanaan. studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa provokasi korban harus dijadikan pertimbangan hakim dalam memutus perkara pidana demi mencapai rasa keadilan dan menjamin tidak adanya kerugian. Hakim dapat memakai Pasal 197 ayat (1) huruf f KUHAP sebagai ruang bagi hakim untuk mempertimbangkan provocative victims sebagai alasan yang meringankan terdakwa serta jika memang RKUHP sudah berlaku, maka dasar hukum atas provocative victims semakin jelas dengan adanya aturan pada Pasal 70 yang menyinggung akan provokasi korban atau provocative victims. Sehingga apa yang dipertimbangkan hakim dalam Putusan Pengadilan Negeri Lubuksikaping nomor 34/PID.SUS/2021/PN LBS sangat tepat untuk mempertimbangkan provocative victims.

The purpose of this study is to examine provocative victims as a matter that can be considered by judges in sentencing decisions. This study uses a normative legal research method with a statutory approach. The results of the study show that provocation of victims must be taken into consideration by judges in deciding criminal cases in order to achieve a sense of justice and ensure the absence of harm. Judges can use Article 197 paragraph (1) letter f of the Criminal Procedure Code as a space for judges to consider provocative victims as a reason that mitigates the defendant and if the Criminal Code is already in effect, then the legal basis for provocative victims is clearer with the rules in Article 70 which allude to provocative victims. So that what the judge considered in the Lubuksikaping District Court Decision number 34/PID.SUS/2021/PN LBS was very appropriate to consider provocative victims.
