KOMPARASI SISTEM PEMILIHAN PRESIDEN POPULAR VOTE DI INDONESIA DENGAN ELECTORAL COLLEGE DI AMERIKA
Abstract
Tujuan studi ini mengkaji mengenai sistem Pemilihan Presiden melalui popular vote di Indonesia dan electoral college di Amerika Serikat yang dianggap sesuai dijalankan oleh negara masing-masing berdasarkan tinjauan filosofis, sosiologis, dan yuridis. Selain itu, menganalisis kelebihan dan kekurangan dari penerapan sistem Pemilihan Presiden melalui popular vote di Indonesia dan electoral college di Amerika Serikat. Studi memakai penelitian hokum normatif, pendekatan perundang-undangan, serta komparatif. Hasil dari studi ini memperlihatkan kecocokan sistem popular vote di Indonesia dan electoral college di Amerika Serikat yang ditinjau secara filosofis, sosiologis, dan yuridis. Masing-masing sistem Pilpres yaitu popular vote di Indonesia dan electoral college di Amerika Serikat memiliki kelebihan dan kekurangan. Dengan popular vote di Indonesia berarti suara tiap orang memiliki nilai yang sama. Berbeda dengan sistem electoral college, dimana Setiap negara bagian mengalokasikan sejumlah suara yang sama dengan jumlah senator dan wakil dalam delegasi kongres Amerika Serikat
The aim of this study is to examine the presidential election system through popular voting in Indonesia and the electoral college that apply in the United States is considered applicable to be run by their respective countries based on philosophical, sociological, and juridical reviews. In addition, analyzing the advantages and disadvantages of implementing the Presidential Election system through popular voting in Indonesia and the electoral college in the United States. this study run with normative legal research methods, statutory, along comparative approach. Results revealed that the compatibility of a popular voting system in Indonesia and the electoral college in the United States was reviewed philosophically, sociologically, and juridically. Each of the presidential election systems, namely popular voting in Indonesia and then electoral college that apply in the United States has advantages and disadvantages. The popular vote in Indonesia means that everyone's vote has the same value. Unlike with the electoral college, every state allocates the same amount of votes as the number of senators along with representatives in the United States congressional delegation.
