PERLINDUNGAN HUKUM TERHADAP KONSUMEN ATAS MELONJAKNYA HARGA MASKER AKIBAT VIRUS COVID-19

Abstract

Virus COVID-19 menimbulkan keresahan bagi masyarakat. Menggunakan masker merupakan salah satu upaya melindungi diri, namun harga masker jenis N95 maupun masker konvensional melonjak. Perlindungan Konsumen adalah suatu cara guna memberi kepada konsumen suatu perlindungan dan suatu jaminan kepastian hukum. Tujuan studi ini untuk menelaah terkait perlindungan hukum terhadap konsumen dan tanggungjawab pelaku usaha terkait dengan melonjaknya harga masker akibat virus COVID-19. Penulisan jurnal ini menerapkan metode penelitian hukum yaitu secara normatif dengan menerapkan pendekatan perundang-undangan serta komparatif. Hasil dari studi menunjukan yaitu Perlindungan hukum terhadap konsumen terkait dengan melonjaknya harga masker akibat virus COVID-19 dalam UU Perlindungan Konsumen, pengaturan guna memperoleh suatu barang yang sangat dibutuhkan sesuai dengan nilai tukar dalam situasi yang mendesak (force majeure) belum optimal dan diperlukan suatu pengaturan spesifik berkaitan dengan hal tersebut. Tanggungjawab pelaku usaha terhadap konsumen terkait dengan melonjaknya harga masker akibat virus COVID-19 dalam Pasal 7 UU Perlindungan Konsumen tersebut tidak dapat ditemukan ketentuan yang mengenai  kewajiban pelaku usaha untuk tetap menjaga nilai tukar barang agar tetap sesuai dengan kondisi dan mutu barang. 


The COVID-19 virus is causing public unrest. Using a mask is one of the efforts to protect themselves, but the price of N95 type masks and conventional masks soared. Consumer Protection is a way to provide protection and guarantees of legal certainty to consumers. The aim of this study is to elucidate or explain legal protections of consumers and business actors responsibility related to soaring mask prices due to the COVID-19 virus. This study used a legal research methode that normative with statutory and comparative approach. The result of this study have shown that legal protections for consumers related to soaring mask prices due to COVID-19 viruses in Consumer Protection Act, arrangements for obtaining much-needed goods in accordance with exchange rates in urgent situations (force majeure) are not optimal and a specific arrangement is required. The responsibility of business actors to consumers is related to the soaring price of masks due to the COVID-19 virus in Article 7 of Consumers Protection Act. It cannot be found that the provisions about the obligations of the business actors to keep the exchange rate of goods in accordance with the conditions and quality of goods.
