PELAKSANAAN PERATURAN TERKAIT UPAH MINIMUM DI PT BPR PENEBEL PADA MASA PANDEMI COVID-19

Abstract

Penelitian ini bertujuan untuk: mengetahui pelaksanaan peraturan terkait Upah Minimum di PT BPR Penebel pada masa pandemi COVID-19; serta mengetahui pemenuhan hak pekerja terkait dengan upah yang didapatkan ditengah pandemi COVID-19. Metode penelitian yang digunakan adalah metode penelitian hukum empiris yang hendak mengetahui apakah terdapat kesenjangan antara norma hukum yang berlaku dengan pelaksanaannya dilapangan. Adapun hasil dari penelitian ini menunjukkan yaitu: pelaksanaan peraturan terkait upah minimum pada masa pandemi COVID-19 di PT BPR Penebel masih berjalan dengan sebagaimana mestinya. Adapun gaji terendah pekerja di PT BPR Penebel saat ini yaitu Rp. 2.700.000,00 per bulan, dimana gaji tersebut sudah lebih dari upah minimum khususnya Upah Minimum Kabupaten Tabanan saat ini; kemudian, berkaitan dengan pemenuhan hak memperoleh upah pekerja ditengah pandemi covid-19, pemerintah telah menerbitkan “Surat Edaran Menteri Ketenagakerjaan No. M/3/HK.04/III/2020 tentang Perlindungan Pekerja dan Kelangsungan Usaha dalam Rangka Pencegahan dan Penanggulangan COVID-19.” Berdasarkan surat edaran tersebut dapat diketahui bahwa ditengah pandemi COVID-19 ini, setiap pekerja bahkan yang terjangkit COVID-19 tetap memiliki haknya yakni memperoleh upah sesuai dengan peraturan perundang-undangan, selain itu dengan mempertimbangkan kelangsungan usahanya akibat COVID-19, pengusaha dapat melakukan perubahan terhadap besaran upah dan tata cara pembayaran upah pekerjanya sesuai kesepakatan dengan pekerjanya. Akan tetapi, surat edaran tidak termasuk dalam kategori peraturan perundang-undangan sehingga baik pekerja maupun pengusaha harus tetap tunduk pada Undang-Undang Ketenagakerjaan.


This research aims to: determine the implementation of regulations regarding the Minimum Wage at Penebel Rural Bank during this COVID-19 pandemic as well as to find out the fulfillment of worker related to the wages earned during this COVID-19 pandemic. Research method that was used is empirical legal research. The results of this research indicate: the implementation of regulations related to the minimum wage during the COVID-19 pandemic at Penebel Rural Bank is still running properly. The lowest salary for workers at Penebel Rural Bank is currently IDR 2,700,000.00 per month, where the salary is already more than the minimum wage, especially the current Minimum Wage for Tabanan Regency; then, regarding to fulfilling the right to get wages for workers during this Covid-19 pandemic, the government has issued Minister of Manpower Circular Number M/3/HK.04/III/2020.  Based on this circular, it can be seen that during this COVID-19 pandemic, every worker/laborer even those infected with COVID-19 still has the right to receive wages in accordance with the statutory regulations, beside that  by considering the continuity of their business due to COVID-19, employers can make changes to the amount of wages and procedures for paying workers/laborers according to the agreement with the worker/laborer. However, circular letters are not included in the category of statutory regulations so that both workers and entrepreneurs must abide by the Labour Law.
