PERLINDUNGAN HUKUM TERHADAP PEGAWAI NON APARATUR SIPIL NEGARA PADA BADAN LAYANAN UMUM

Abstract

Penelitian ini bertujuan untuk menemukan urgensi perlindungan hukum pegawai Non Aparatur Sipil Negara dalam mewujudkan hak dan karier pada Badan Layanan Umum di PIP Semarang dan menemukan model perlindungan hukum pegawai Non Aparatur Sipil Negara dalam mewujudkan hak dan karier pada Badan Layanan Umum. Metode penelitian ini menggunakan jenis penelitian yuridis sosiologis dengan pendekatan kualitatif. Data penelitian diperoleh dari tinjauan pustaka dan wawancara, dianalisis secara kualitatif dan disajikan secara deskriptif. Berdasarkan hasil penelitian, masih terdapat pegawai non-ASN BLU PIP Semarang yang belum terpenuhi hak cuti, hak gaji, hak berpendapat, dan kesempatan peningkatan karier. Hak cuti hanya diberikan selama 6 (enam) hari dari 12 (dua belas) hari berdasarkan perundang-undangan. Hak gaji yang diperoleh sebagian besar sama nilainya meskipun keterampilan dan tingkat pendidikannya berbeda secara signifikan. Tidak terdapat ruang untuk mengemukakan pendapat, hanya evaluasi saat masa kontrak akan berakhir. Perjanjian kerja menyatakan pengembangan kompetensi namun kenyataannya tidak diperoleh. Peluang peningkatan karier juga sulit didapatkan. Berdasarkan hal tersebut, adanya urgensi perlindungan hukum pegawai yang belum dipenuhi baik secara empiris, sosiologis, dan yuridis untuk dapat memperoleh hak dan kariernya. Model perlindungan hukum secara umum berupa perlindungan hukum preventif dan represif serta secara khusus berdasarkan Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan berupa perlindungan hak-hak pekerja. Terdapat model-model yang dapat diterapkan dengan menggunakan aspek institusional, aspek struktural, dan aspek budaya.


ABSTRACT


This study aims to find the urgency of legal protection for non-State Civil Apparatus employees in realizing rights and careers in public service agencies at PIP Semarang and find legal protection models for non-State Civil Apparatus employees in realizing rights and careers in public service agencies. This research method uses a type of sociological-legal research with a qualitative approach. Research data were obtained from literature reviews and interviews, analyzed qualitatively, and presented descriptively. Based on the results of the study, there are still non-ASN BLU PIP Semarang employees whose leave rights, salary rights, opinion rights, and career advancement opportunities have not been fulfilled. Leave entitlement is only granted for 6 days out of 12 days under the law. The salary entitlement earned is largely equal in value, even though the skills and level of education differ significantly. There is no room to express opinions; only evaluation will occur when the contract period expires. The employment agreement states competency development, but in reality, it is not obtained. Career advancement opportunities are also hard to come by. Based on this, there is an urgency in employee legal protection that has not been fulfilled both empirically, sociologically, and juridically to be able to obtain their rights and careers. The model of legal protection in general is in the form of preventive and repressive legal protection, specifically based on Law No. 13 of 2003 concerning manpower in the form of protection of workers' rights. There are models that can be applied using institutional aspects, structural aspects, and cultural aspects.
