STRATEGI PENEGAKAN HUKUM TERHADAP PERILAKU MEROKOK SAAT BERKENDARA DI KABUPATEN TABANAN

Abstract

Pada akhir Mei 2022, Satlantas Polres Tabanan melaporkan 208 insiden kecelakaan lalu lintas, meningkat dari 180 kasus tahun 2021, dan merokok saat berkendara adalah salah satu penyebabnya. Hasilnya dari 89 penduduk Tabanan, 26% merokok sebagai kebiasaan saat berkendara. Inilah penyebab sulitnya menghilangkan kebiasaan merokok saat berkendara, meskipun pihak terkait telah melakukan tindakan hukum. Studi ini menyelidiki dasar yuridis penegakan hukum terhadap pelaku serta strategi hukum menangani masalah ini di Kabupaten Tabanan dengan pendekatan empiris, serta data primer seperti wawancara dan kuesioner dan data sekunder dari teori hukum dan peraturan yang relevan. Pasal 106 ayat (1) UU LLAJ dan Permenhub No 12/2019 tentang Keselamatan Pengguna Sepeda Motor untuk Kepentingan Masyarakat menetapkan sanksi terkait dengan perilaku merokok saat berkendara. PP No 80/2012 tentang Tata Cara Pemeriksaan Kendaraan Bermotor di Jalan dan Penindakan Pelanggaran Lalu Lintas dan Angkutan Jalan, serta UU ITE, merupakan dasar hukum strategi penegakan hukum di Kabupaten Tabanan. PERMA No 12/2016 tentang Tata Cara Penyelesaian Perkara Pelanggaran Lalu Lintas menetapkan prosedur untuk menerapkan sistem E-tilang.

ABSTRACT

At the end of May 2022, Satlantas Polres Tabanan reported 208 incidents of traffic accidents, an increase from 180 cases in 2021, and smoking while driving was one of the causes. The result is that out of 89 Tabanan residents, 26% smoke as a habit while driving. This is the cause of the difficulty in eliminating smoking while driving, even though the relevant parties have taken legal action. This study investigates the juridical basis of law enforcement against perpetrators as well as the legal strategy of dealing with this issue in Tabanan District with an empirical approach, as well as primary data such as interviews and questionnaires and secondary data from legal theories and relevant regulations. Article 106 paragraph (1) of the LLAJ Law and Minister of Transportation Regulation No. 12 of 2019 on the Safety of Motorcycle Users for the Benefit of the Public stipulate sanctions related to smoking while driving. Government Regulation No 80 of 2012 on the Procedure for Inspection of Motor Vehicles on the Road and Enforcement of Road Traffic and Transportation Violations, as well as the ITE Law, are the legal basis for law enforcement strategies in Tabanan District. PERMA No. 12 of 2016 on the Procedure for Settlement of Traffic Violation Cases establishes the procedure for implementing the E-ticketing system.
