EKSISTENSI BPOM DALAM PERLINDUNGAN KONSUMEN TERHADAP OBAT YANG MENGANDUNG ZAT DIETILEN GLIKOL DAN ETILEN GLIKOL

Abstract

Penelitian ini dilakukan denngan tujuan untuk mengkaji bagaimana peran bpom dalam pengawasan dan peredaran obat yang mengandung zat atau kandungan dietilen glikol (deg) dan etilen glikol (eg) serta mengkaji bagaimana perlindungan hukum terhadap konsumen obat yang mengandung zat (deg) dan (eg) mengacu kepada peraturan yang sedang berlaku. Metode yang dipakai dalam penulisan Jurnal ini yakni metode penelitian Hukum Normatif dimana penelitian didasarkan atas analisis terhadap peraturan perundang-undangan yang berlaku serta relevan terhadap permasalahan hukum yang dimana dijadikan objek atau fokus dalam jurnal yakni Eksistensi BPOM dalam Perlindungan Konsumen terhadap Obat yang Mengandung Zat Dietilen Glikol dan Etilen Glikol. Jenis pendekatan yang dilakukan berupa Pendekatan Kasus (The Case Approach), kemudian Pendekatan Perundang-Undangan (The Statute Approach), serta jenis Pendekatan Fakta (The Fact Approach). Dalam penelitian diuraikan terkait permasalahan yang terjadi dimana selanjutnya dikaitkan dengan peraturan yang berlaku. Pengawasan yang dilakukan oleh BPOM terhadap kasus di atas telah dilakukan sesuai dengan program-program sesuai peraturan yang berlaku. Namun masih adanya kekurangan dalam hal standarisasi berkaitan dengan Zat Dietilen Glikol Dan Etilen Glikol tersebut sehingga perlu diatur serta diterapkan terkait dengan hal tersebut mengingat belum adanya pengaturan dari standarisasi kedua kandungan zat tersebut. Serta terkait juga dengan pemberian informasi kepada masyarakat agar adanya transparasi berkaitan dengan hal tersebut. Berkaitan dengan penegakan hukum yang diberikan oleh BPOM telah dilakukan upaya hukum preventif dan represif.

ABSTRACT

This research was conducted with the aim of examining the role of BPOM in controlling and distributing drugs containing diethylene glycol (deg) and ethylene glycol (eg) and examining how the legal protection for consumers of drugs containing deg and eg relates to the current regulations. The method used in writing this journal is the normative legal research method, where the research is based on an analysis of applicable laws and regulations and is relevant to legal issues that are used as objects or focuses in the journal, namely the existence of BPOM in the protection of drug consumers for drugs containing diethylene substances such as glycol and ethylene glycol. The types of approaches used are the case approach, the statute approach, and the fact approach. In this research, it is described in relation to the problems that occur, which are then linked to the applicable regulations. The supervision carried out by BPOM on the above cases has been carried out in accordance with programs according to applicable regulations. However, there are still deficiencies in terms of standardization related to diethylene glycol and ethylene glycol, so it needs to be regulated and implemented in this regard considering that there is no regulation of the standardization of the two substance contents. It is also related to providing information to the public so that there is transparency in this regard. Regarding law enforcement provided by BPOM, preventive and repressive legal efforts have been made.
