PENGATURAN HUKUM VIDEO GAME CENSORSHIP MENURUT HUKUM POSITIF INDONESIA
Abstract
Penelitian ini memiliki tujuan menganalisis pengaturan hukum Video Game Censorship menurut hukum positif di Indonesia. Jenis penelitian yang digunakan adalah penelitian hukum normatif. Hasil penelitian ini menunjukkan bahwa pengaturan video game censorship dalam hukum positif di Indonesia belum diatur secara khusus, namun prinsip dasar serta ketentuan aturan-aturan yang berhubungan dengan pemberlakuan sensor terhadap video game di Indonesia telah diatur dalam beberapa undang – undang dan peraturan mulai dari Undang - Undang Dasar NRI 1945, Undang – Undang Nomor 33 Tahun 2009 Tentang Perfilman, Peraturan Pemerintah Nomor 18 Tahun 2014 Tentang Lembaga Sensor Film, Undang – Undang Nomor 19 Tahun 2016 Tentang ITE hingga Peraturan Menteri Nomor 11 Tahun 2016 Tentang Klasifikasi Permainan Interaktif Elektronik yang dimana memilki pasal-pasal terkait dan aturan pendukung pemberlakuan video game censorship.
This study aims to analyze the legal arrangements of Video Game Censorship according to positive law in Indonesia. The type of research used is normative legal research. The results of this study indicate that the regulation of video game censorship in positive law in Indonesia has not been specifically regulated, but the basic principles and provisions relating to the application of censorship of video games in Indonesia have been regulated in several laws and regulations starting from Law - The 1945 Constitution of the Republic of Indonesia, Law Number 33 of 2009 concerning Film, Government Regulation Number 18 of 2014 concerning Film Censorship Institutions, Law Number 19 of 2016 concerning ITE to Ministerial Regulation Number 11 of 2016 concerning Classification of Electronic Interactive Games which have related articles and supporting rules for implementing video game censorship.
