PERLINDUNGAN HAK KEKAYAAN INTELEKTUAL TERHADAP KESENIAN BARONG NONG-NONG KLING DESA AAN SEBAGAI EKSPRESI BUDAYA TRADISIONAL

Kesenian Barong Nong-Nong Kling yang berasal dari desa Aan sebagai salah satu dari kesenian tradisional yang perlu dilestarikan serta mendapat upaya perlindungan sebagai ekspresi budaya stradisional milik Indonesia, karena merupakan perwujudan nilai-nilai tradisi budaya local dan warisan leluhur yang sangat berharga bagi masyarakat Desa Aan sehingga penting untuk dilindungi. Tujuan studi ini untuk mengetahui kesenian Barong Nong-Nong Kling termasuk sebagai objek perlindungan Ekspresi Budaya Tradisional dalam Hukum Kekayaan Intelektual serta perlindungan hukum bagi Kesenian Barong Nong-Nong Kling Sebagai Ekspresi Budaya Tradisional Berdasarkan Undang-Undang Hak Cipta.  Studi ini menggunakan metode penelitian hukum yuridis normative dengan pendekatan perundang-undangan dan komparatif. Hasil studi menunjukan bahwa kesenian Barong Nong-Nong Kling termasuk sebagai objek perlindungan ekspresi budaya tradisional dalam Hukum Kekayaan Intelektual yaitu berdasarkan Undang-Undang No 28 Tahun 2014 Tentang Hak Cipta namun dalam implementasinya perlindungan hukum terhadap kesenian Barong Nong-Nong Kling belum mampu terlaksana secara efektif. Factor- factor yang mempengaruhi terhambatnya pelaksanaan perlindungan hukum bagi Kesenian Barong Nong-Nong Kling sebagai ekspresi budaya tradisional diantaranya factor pemahaman hukum, lingkungan, fasilitas serta factor kebudayaan.

Barong Nong-Nong Kling art originating from Aan village is one of the traditional arts that needs to be preserved and protected as an expression of Indonesia's traditional culture, because it is an embodiment of the values ??of local cultural traditions and ancestral heritage which is very valuable for the people of Aan Village. Important to protect. The purpose of this study is to determine whether the art Barong Nong-Nong Kling art is included as an object of protection of Traditional Cultural Expressions in Intellectual Property Law and legal protection of Barong Nong-Nong Kling Art as Traditional Cultural Expressions under the Copyright Act. This study uses normative juridical law research methods statutory and comparative approach. The results of the study show that the art of Barong Nong-Nong Kling is included as an object of protection for traditional cultural expressions in Intellectual Property Law, namely based on Law No. 28 of 2014 concerning Copyright, but in its implementation the legal protection for the art of Barong Nong-Nong Kling has not been able to be carried out effectively. The factors that influence the delay in the implementation of legal protection for traditional cultural expressions are the legal understanding factor, environmental factors, facilities and facilities factors and cultural factors.
