Penguasaan Negara Atas Ekspresi Budaya Tradisional Dalam Perspektif Hak Cipta di Indonesia

Tujuan penelitian ini adalah memahami kedudukan negara sebagai pemegang Hak Cipta atas Ekspresi Budaya Tradisional (EBT) dalam Undang-Undang No. 28 Tahun 2014 Tentang Hak Cipta dan untuk mengetahui status masyarakat adat sebagai pelaksana dalam pelestarian EBT dalam perspektif Hak Cipta. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa kedudukan negara sebagai pemegang hak cipta atas ekspresi budaya tradisional termuat dalam ketentuan Pasal 38 dan Pasal 39 menjekaskan kedudukan negara adalah sebagai pemgang otorisasi atas EBT. Sedangkan status masyarakat adat sebagai pelaksana dalam pelestarian EBT dalam perspektif hukum Hak Cipta tidak diatur secara eksplisit dalam UUHC namun sebagai masyarakat yang sudah turun temurun tentu perlu dipertegas bahkan diberikan hak sebagai Pemegang Hak Cipta atas EBT.

ABSTRACT
The purpose of this research is to understand the position of the state as the holder of the Copyright for Traditional Cultural Expressions (EBT) in Law No. 28 of 2014 concerning Copyright and to find out the status of indigenous peoples as executors in the conservation of EBT from a Copyright perspective. The research method used in this study is a normative legal research method with a statutory and conceptual approach. The results show that the state's position as the copyright holder of traditional cultural expressions is contained in the provisions of Article 38 and Article 39 of the UUHC which emphasize that the state's position is as the holder of authorization for EBT. Meanwhile, the status of indigenous peoples as executors in the conservation of EBT in the perspective of Copyright law is not explicitly regulated in the UUHC, but as a community that has been passed down from generation to generation, it certainly needs to be affirmed and even given rights as Copyright Holders of EBT.
