PELAKSANAAN DISEMINASI PENTINGNYA PENDAFTARAN KEKAYAAN INTELEKTUAL SELAMA PANDEMI (STUDI PADA KANWIL KEMENKUMHAM BALI)

Abstract

ABSTRAK

Tujuan penulisan studi ini untuk menjelaskan pelaksanaan diseminasi oleh Kantor Wilayah Kementerian Hukum dan HAM Bali perihal pentingnya pencatatan kekayaan intelektual bagi UMKM selama pandemi serta faktor-faktor UMKM melakukan pendaftaran kekayaan intelektual. Dengan menggunakan metode penelitian hukum yuridis empiris berupa pendekatan fakta secara deskriptif, studi ini juga didukung instrumen lain seperti interview. Hasil studi menjelaskan terlaksananya 3 kegiatan diseminasi kekayaan intelektual merupakan amanat Pasal 45 ayat (2) Permenkumham RI Nomor 30 tahun 2018, namun pelaksanaannya belum efektif mengingat cakupan diseminasi masih terbatas pada UMKM di wilayah Denpasar serta belum dilakukan secara merata. Sisi positifnya adalah pelaksanaan diseminasi terbukti mampu meningkatkan pemahaman mengenai kekayaan intelektual sehingga terjadi peningkatan pendaftaran kekayaan intelektual mandiri secara online. Selanjutnya, berkaitan dengan faktor UMKM melakukan pencatatan kekayaan intelektual, sebagian besar faktor penghambat dipengaruhi oleh kurang awamnya pemahaman mengenai kekayaan intelektual di masyarakat sedangkan faktor pendukung dipengaruhi oleh proses pendaftaran yang lebih sederhana kini berlangsung secara online.

ABSTRACT 

This article intends to elucidates the execution of dissemination by the Regional Office of the Ministry of Law and Human Rights in Bali related to importance through intellectual property registration towards MSMEs during the pandemic and the factors for MSMEs to register intellectual property. By using empirical juridical law study methods in the shape of a descriptive fact approach, this study is also supported by other instruments such as interviews. The outcome through this study elucidates that the execution through 3 intellectual property dissemination activities be in accordance with the mandate of Article 45 paragraph (2) of the Minister of Law and Human Rights of the Republic of Indonesia Number 30 of 2018, however the implementation has not been effective considering that the scope of dissemination is still limited to MSMEs in Denpasar area and has not been carried out evenly. The positive side is that the implementation of dissemination is proven to be able to increase understanding of intellectual property so that there is an increase in independent intellectual property registration online. Furthermore, related to the MSMEs factor in recording intellectual property, most of the inhibiting factors are influenced by the lack of understanding of intellectual property, while the supporting factors are influenced by the simpler registration process which is now taking place online.
