KEMUDAHAN BAGI UMKM DALAM MENGEMBANGKAN USAHA : PERSPEKTIF UNDANG-UNDANG CIPTA KERJA

Abstract

Tujuan studi ini untuk mengkaji kemudahan yang didapat UMKM dari berlakunya UU Cipta Kerja, selain itu juga tulisan ini akan membahas mengenai pengaturan mekanisme pendirian perusahaan bagi UMKM yang telah diatur dalam UU Cipta Kerja. Studi ini menggunakan metode penelitian hukum normatif yang disertai dengan penggunaan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa dengan berlakunya UU Cipta Kerja nyatanya dapat mempengaruhi perkembangan UMKM karena beberapa pasal dalam UU tersebut memberi kemudahan bagi UMKM khususnya dalam hal perizinan, pembiayaan, dan perlindungan hukum. Dalam UU Cipta Kerja juga telah mengatur mengenai mekanisme pendirian perusahaan bagi UMKM melalui penyisipan Pasal 153A sampai dengan pasal 153J dalam UUPT yang ditindaklanjuti dengan Peraturan Pemerintah Nomor 8 Tahun 2021 tentang Modal Dasar Perseroan Serta Pendaftaran Pendirian, Perubahan, dan Pembubaran Perseroan yang Memenuhi Kriteria Untuk Usaha Mikro dan Kecil.

The purpose of this study is to review the ease obtained by UMKM from the enactment of Law No. 11 of 2020 on Copyright Work, in addition to this paper will discuss the arrangement of the mechanism of establishment of companies for UMKM that have been regulated in the Omnibus Law. This study uses normative legal research methods with a statutory approach. The results of the study showed that with the enactment of the Omnibus Law, it can actually affect the development of UMKM because some articles in the Law provide convenience for UMKM, especially in terms of licensing, financing, and legal protection. In the Omnibus Law, the Work Has also set up the mechanism of establishment of companies for UMKM through the insertion of Article 153A up to article 153J in the UUPT followed up by Government Regulation No. 8 of 2021 concerning The Company's Authorized Capital as well as registration of establishment, change, and dissolution of companies that meet the criteria for micro and small businesses.
