Pengaturan Pengawasan Pemerintah Terhadap Pengurangan Penggunaan Sampah Plastik Di Provinsi Bali

Abstract

Tujuan dari penulisan jurnal ini ialah untuk mengkaji terkait pengaturan-pengaturan terkait pengurangan sampah plastik dan untuk mengetahui akibat hukum yang terjadi dalam penyelesaian konflik norma antara dua peraturan yang masih berlaku. Metode peneletian yang digunakan dalam penulisan ini ialah metode penelitian hukum normatif. Adanya perbedaan isi dari Peraturan Gubernur No 97 Tahun 2018 tentang Pembatasan Timbulan Sampah Plastik Sekali Pakai dan Peraturan Walikota Denpasar No 36 Tahun 2018 tentang Pengurangan Penggunaan Kantong Plastik menibulkan suatu konflik norma. Hasil dari penelitian jurnal ini adalah penyelesaian terkait konflik norma tersebut dapat diselesaikan dengan menggunakan asas-asas yang ada dalam hukum. Selain itu juga telah dijelaskan terkait upaya pengawasan yang dilakukan oleh pemerintah yaitu dengan pengawasan aposteriori yang mengandung unsur represif.

ABSTRACT

This The purpose of writing this journal is to examine the regulations related to reducing plastic waste and to find out the legal consequences that occur in resolving the conflict of norms between the two regulations that are still in effect. The research method used in this paper is a normative legal research method. There are differences in the contents of Governor Regulation No. 97 of 2018 concerning Restrictions on the Generation of Single-use Plastic Waste and Denpasar Mayor Regulation No. 36 of 2018 concerning Reducing the Use of Plastic Bags, causing a conflict of norms. The result of this journal research is that the resolution related to the conflict of norms can be resolved using the principles contained in the law. In addition, it has also been explained related to the supervision efforts carried out by the government, namely the aposteriori supervision which contains repressive elements.
