HAK WARIS ANAK BERBEDA AGAMA DALAM HUKUM WARIS ADAT BALI
Abstract
Tujuan studi ini untuk mengkaji terkait pengaturan hak waris menurut Hukum Waris Adat Bali dan hak waris anak dalam perkawinan Hindu Bali yang berbeda agama dengan orang tuanya. Adapun dalam penelitian ini digunakan metode hukum normatif dengan menerapkan statute approach. Sebab adanya kekaburan norma, dimana telah diatur dalam perundang-undangan, namun masih tidak jelas. Hasil studi menunjukkan bahwasannya pengaturan hak waris menurut Hukum Waris Adat Bali berdasarkan pada pelaksanaan swadharma yang telah dilakukan oleh ahli waris. Hak waris anak dalam perkawinan Hindu Bali bergantung pada sah atau tidaknya suatu perkawinan tersebut. Apabila anak memutuskan untuk berpindah agama yang sebelumnya beragama Hindu ke agama lainnya, maka akan memberikan dampak anak kehilangan status sebagai ahli waris. Sebab anak dianggap tidak dapat menjalankan tanggung jawabnya lagi. Selain itu anak dianggap telah ninggal kedaton. Sehingga anak tidak berhak atas warisan sebagai ahli waris. Namun hal ini kembali lagi kepada kesepakatan keluarga masing-masing.

ABSTRACT
The purpose of this study is to examine the regulation of inheritance rights according to Balinese Customary Inhertance Law and the inhertance right of children in Balinese Hindu marriages of different religions. As for this research, the normative legal method is used by applying the statute approach. This is because there is a blurring of norms, which have been regulated in legislation, but are still unclear. The results of the study shows that arrangement of inheritance rights according to Balinese Customary Inheritance Law is based on the implementation of swadharma that has been carried out by the heirs. The inheritance rights of children in Balinese Hindu marriages depend on wether the marriage is valid or not. If the child decides to change the religion that was previously Hindu to another religion, it will have an impact on the child losing status as an heir. Because children are considered unable to carry out their responsibilities anymore. In addition, the child is considered to have died at ninggal kedaton. So that children are not entitled to inhertitance as heirs. But this goes back to the agreement of their respective families.
