KEDUDUKAN DAN PERLINDUNGAN WARTAWAN DALAM UNDANG-UNDANG NOMOR 19 TAHUN 2016 TENTANG INFORMASI DAN TRANSAKSI ELEKTRONIK (ITE)

Abstract

Seorang jurnalis merupakan individu yang secara rutin melaksanakan tugas dan peran dalam bidang jurnalistik dengan tujuan menyampaikan informasi kepada masyarakat. Undang-Undang Pers memberikan perlindungan hukum kepada jurnalis dan mengatur melalui penerapan Kode Etik Jurnalistik. Namun, keberlakuan Undang-Undang No 19 tahun 2016 tentang Informasi dan Transaksi Elektronik (UU ITE) menimbulkan ketidakpastian bagi jurnalis karena adanya pasal-pasal yang dianggap mengancam kebebasan pers dan keselamatan mereka, seperti kasus pencemaran nama baik. Fokus penelitian ini adalah bagaimana regulasi hukum terhadap jurnalis dalam menjalankan tugasnya, serta bagaimana posisi hukum jurnalis yang dianalisis secara normatif berdasarkan UU ITE. Penelitian ini menggunakan metode penelitian hukum secara pengkajian normatif hal ini bertujuan untuk mencari solusi terkait prosedur pengaturan hukum terhadap jurnalis agar kebebasan pers dan hak berpendapat dapat tetap dijaga. Tantangan lainnya adalah ketiadaan ketentuan yang jelas mengenai status jurnalis dalam Undang-Undang ITE, sehingga membuat jurnalis belum sepenuhnya merasa bebas dan rentan terhadap ancaman hukuman ketika menjalankan tugas sebagai penyedia dan penghubung informasi untuk masyarakat luas.

ABSTRACT

A journalist is an individual who routinely carries out duties and roles in the journalistic field with the aim of conveying information to the public. The Press Law provides legal protection to journalists and regulates the implementation of the Journalistic Code of Ethics. However, the implementation of Law No. 19 of 2016 concerning Information and Electronic Transactions (UU ITE) creates uncertainty for journalists because of the existence of articles that are considered to threaten press freedom and their safety, such as cases of defamation. The focus of this research is how legal regulations apply to journalists in carrying out their duties, as well as how the legal position of journalists is analyzed normatively based on the ITE Law. This research uses legal research methods with a normative assessment, this aims to find solutions related to legal regulatory procedures for journalists so that press freedom and the right to opinion can be maintained. Another challenge is the absence of clear provisions regarding the status of journalists in the ITE Law, which means that journalists do not feel completely free and are vulnerable to the threat of punishment when carrying out their duties as providers and liaisons of information to the wider community.
