IMPLEMENTASI SISTEM MUSYAWARAH MUFAKAT DALAM PEMILIHAN BENDESA ADAT DI DESA ADAT PECATU

Abstract

Tujuan penulisan ini adalah untuk menganalisis tentang implementasi serta hambatan dalam pemilihan Bendesa Adat di Desa Adat Pecatu pasca diterbitkannya Perda Bali tentang Desa Adat. Penelitian ini ditulis dengan penelitian hukum empiris, yang berarti memiliki parameter yakni adanya kesenjangan antara hukum positif dengan implemetasi di masyarakat. Hasil penelitian ini menunjukan bahwa pengaturan pemilihan Bendesa adat di Desa Adat Pecatu secara normatif telah sesuai dan sejalan dengan pengaturan yang terdapat dalam Perda Bali tentang Desa Adat dan pedoman dari Majelis Desa Adat (MDA), namun mekanisme pemilihan dengan sistem musyawarah mufakat dalam pemilihan Bendesa adat di desa adat pecatu belum terlaksana dengan baik. Terdapat beberapa kendala dan hambatan dari desa adat pecatu dalam menjalankan musyawarah pemilihan Bendesa adat, diantaranya adalah banyaknya jumlah krama desa, pelaksanaan pemilihan Bendesa adat di bali terlaksana di tengah situasi pandemi Covid-19 dan tingginya pengaruh politik praktis.

The purpose of this study is to analyze the implementation of the election of the Traditional Village Head in Pecatu Traditional Village after the issuance of the Bali Regional Regulation on Traditional Villages. This research is written with empirical legal research, which means that it has parameters, namely the gap between positive law and implementation in society. The results of this study indicate that the arrangement for selecting customary bandes in Pecatu Traditional Village is normatively appropriate and in line with the arrangements contained in the Bali Regional Regulation on Traditional Villages and guidelines from the Traditional Village Council (MDA), but the election mechanism is with a consensus deliberation system in the selection of customary bandes. in the customary village of Pecatu has not been carried out properly. There were several obstacles and obstacles from the Pecatu customary village in carrying out the customary Bendesa election deliberations, including the large number of village krama, the implementation of the customary Bendesa election in Bali was carried out in the midst of the Covid-19 pandemic situation and the high influence of practical politics.
