PERSAIANGAN DALAM PELAKSANAAN JABATAN NOTARIS DALAM PERSPEKTIF PERSAINGAN TIDAK SEHAT TARIF HONARARIUM

Abstract

Penelitian ini bertujuan untuk mengidentifikasi persaiangan notaris dalam UUJN serta dampak persaingan tidak sehat didalam menjalankan jabatan notaris dengan menurunkan nilai honorarium serta menganalisis implementasi dari penegakan UUJN terhadap persaingan tidak sehat. Penelitian ini menggunbakan metode penelitian normatif dengan pendekatan undang undang dan pendekatan kasus, dan dari hasil di dapat dampak yang terasa bagi para pejabat publik tersebut dimana didalam praktiknya ditemui terdapat beberapa oknum notaris yang melanggar dan atau menyimpangi aturan dalam UUJN khususnya dalam pasal 36 tentang honorarium notaris itu sendiri dan peranan Majelis Pengawas Notaris sebagai perpanjangan tangan dari INI mengawasi setiap notaris dalam melakukan tugasnya majelis pengawas sendiri selain memantau kinerja dari pada pejabat public tersebut juga menerima aduan atau laporan dari masyarakat dengan demikian INI dapat mengurangi resiko dari tindakan pelanggaran notaris itu sendiri.

This study aims to identify notary competition in UUJN and the impact of unfair competition in running a notary position by lowering the honorarium and analyze the implementation of UUJN enforcement against unfair competition. This research uses a normative research method with a statutory approach and a case approach, and from the results obtained the impact is felt for these public officials where in practice there are several notaries who violate and or deviate from the rules in the UUJN, especially in Article 36 regarding the notary's honorarium. itself and the role of the Notary Supervisory Council as an extension of INI supervising each notary in carrying out its duties the supervisory board itself in addition to monitoring the performance of the public official also receives complaints or reports from the public thus INI can reduce the risk of a notary violation itself.
