PENERAPAN PRINSIP “FIRST TO FILE” PADA KONSEP PENDAFTARAN MEREK DI INDONESIA
Abstract
Konsep pendaftaran merek di Indonesia menganut prinsip “First to File” yang artinya perlindungan hukum akan diberikan kepada pemilik merek yang telah mendaftarkan terlebih dahulu ke Direktorat Jenderal Kekayaan Intelektual pada Kementerian Hukum dan Hak Asasi Manusia. Namun prinsip “First to File” dalam konsep pendaftaran merek di Indonesia dapat dikesampingkan apabila ditemukan bukti-bukti saat proses pendaftaran merek tidak beritikad baik dan melanggar peraturan perundang-undangan. Oleh karena itu prinsip “First to File” dalam konsep pendaftaran merek di Indonesia tidak berlaku absolut sebagaimana makna yang terkandung didalamnya. Selain itu prinsip tersebut seringkali digunakan oleh pihak lain untuk mendompleng merek terkenal pemilik yang sebenarnya namun belum mendaftarkan di Indonesia. Sehingga hal ini menjadi kekosongan hukum atas penerapan perlindungan hukum merek di Indonesia. Adapun penelitian ini pada hakikatnya untuk memahami dan mengidentifikasi perlindungan merek di Indonesia dengan menggunakan metode yang mendasarkan pada penelitian kepustakaan. Berdasarkan hal tersebut maka kita dapat mengetahui dan memahami bahwasanya penerapan prinsip “First to File” dalam konsep perlindungan merek di Indonesia tidak berlaku mutlak apabila ditemukan unsur-unsur itikad tidak baik dalam proses pendaftaran merek.

So that this becomes a legal vacuum for the application of brand legal protection in Indonesia. This research is essentially to understand and identify brand protection in Indonesia using methods that are based on literature research. Based on this, we can know and understand that the application of the "First to File" principle in the concept of brand protection in Indonesia does not apply absolutely if elements of bad faith are found in the trademark registration process.
