PERLINDUNGAN HUKUM TERHADAP PEMBELI BERITIKAD BAIK ATAS JUAL BELI HAK ATAS TANAH

Abstract

Tujuan dari penelitian ini adalah untuk menganalisis perlindungan hukum terhadap pembeli beritikad baik atas jual beli hak atas tanah di Indonesia serta menganalisis akibat hukum terhadap gugatan pembatalan akta jual beli dalam hal pembeli beritikad baik. Jenis penelitian ini adalah penelitian normatif. Hasil penelitian menunjukan bahwa p?d? pr?ktikny? putus?n y?ng dikelu?rk?n setel?h terbitny? SEM? Nomor 4 T?hun 2016, d?l?m menggun?k?n SEM? seb?g?i d?s?r pertimb?ng?n untuk menentuk?n kriteri? pembeli beritik?d b?ik, h?kim dalam Putusan Tingkat Pertama, Putusan Tingkat Banding , dan Putusan tingkat kasasi belum mel?kuk?n sesu?i petunjuk y?ng terter? d?l?m SEM?. Berdasarkan Putusan Mahkamah Agung Nomor 909 PK/Pdt/2020 yang diteliti bahwa dalam permohonan peninjauan kembali hakim baru memberikan pertimbangan tentang pembeli beritikad baik sesuai SEMA.

The purpose of this study is to analyze the legal protection of buyers in good faith for the sale and purchase of land rights in Indonesia and to analyze the legal consequences of lawsuits against deed of sale and purchase in the case of buyers with good intentions. This type of research is normative research. The results of the research show that in practice the decisions that were issued after the publication of SEM? Number 4 of 2016, in use SEMA as a basis for consideration to determine the criteria for the Buyer's Decision, the First court, court of appealed and Cassation not reffered SEM? for the Adjudication. Based on the Supreme Court's Adjudication Number 909 PK/Pdt/2020, it was examined that in the application for review, the judge gave consideration to buyers with good intentions according to SEMA.
