ANALISIS AKTA PERDAMAIAN DALAM PUTUSAN PENGADILAN NEGERI PADANG NOMOR 14/Pdt.G.S/2020/PN.Pdg

Abstract

Tujuan penelitian ini dilakukan untuk menganalisis Akta Perdamaian dalam putusan Pengadilan Negeri Padang Nomor 14/Pdt.G.S/2020/PN.Pdg dan akibat hukum yang timbul apabila salah satu pihak wanprestasi terhadap isi Akta Perdamaian dalam Putusan Pengadilan Negeri Padang Nomor 14/Pdt.G.S/2020/PN.Pdg. Metode yang digunakan dalam penelitian ini yaitu metode penelitian yuridis – normatif dengan mengacu kepada bahan hukum primer yaitu peraturan perundang-undangan, bahan hukum sekunder yaitu buku – buku, dan bahan hukum tersier yang terkait dengan penelitian ini. Hasil penelitian menunjukkan bahwa isi Akta Perdamaian dalam Putusan Pengadilan Negeri Padang Nomor 14/Pdt.G.S/2020/PN.Pdg mengatur tentang kesepakatan pengembalian hutang oleh Tergugat kepada Penggugat dan Tergugat menyepakati untuk memindahkan gajinya ke Bank X Cabang Padang. Akta Perdamaian tersebut setelah diteliti, sesuai dengan ketentuan pembuatan Akta Perdamaian sehingga berlaku sah, mengikat Penggugat dan Tergugat dan pada Akta Perdamaian tersebut melekat sifat khusus yaitu eksekutorial. Akibat hukum apabila salah satu pihak wanprestasi terhadap isi Akta Perdamaian dalam Putusan Nomor 14/Pdt.G.S/2020/PN.Pdg ini adalah pihak yang dirugikan secara langsung dapat memintakan atau mengajukan permohonan eksekusi kepada Ketua Pengadilan, agar pihak yang wanprestasi dapat di tuntut secara paksa untuk memenuhi isi putusan perdamaian berdasarkan Akta Perdamaian yang telah disepakati.

The purpose of this study was to analyze the Deed of Peace in the decision of the Padang District Court Number 14/Pdt.GS/2020/PN.Pdg and the legal consequences that arise if one party defaults on the contents of the Peace Deed in the Padang District Court Decision Number 14/Pdt.GS /2020/PN.Pdg. The method used in this research is the juridical – normative research method concerning primary legal materials, namely legislation, secondary legal materials, namely books, and tertiary legal materials related to this research. The results showed that the contents of the Deed of Reconciliation in the Padang District Court Decision Number 14/Pdt.G.S/2020/PN.Pdg regulates the agreement to repay the debt by Defendant to Plaintiff and Defendant agreed to transfer his salary to X Bank Padang Branch. After examining the Peace Deed, it is in accordance with the provisions of the making of the Peace Deed so that it is valid, binding on the Plaintiff and the Defendant and the Composition Deed has a special character, namely executive. The legal consequences if one of the parties fails to comply with the contents of the Peace Deed in Decision Number 14/Pdt.GS/2020/PN.Pdg is that the aggrieved party can directly request or submit a request for execution to the Chairperson of the Court so that the party who is in default can be sued by force to fulfill the contents of the peace decision based on the agreed Peace Deed.
