PENGATURAN HAK PENGELOLAAN LAHAN (HPL) PASCA BERLAKUNYA UNDANG-UNDANG CIPTA KERJA

Abstract

Artikel ini ditulis dengan tujuan untuk mengetahui pengaturan hak pengelolaan lahan serta untuk mengetahui dan problematika yang mungkin muncul terkait dengan pengaturan hak pengelolaan lahan pasca berlakunya Undang-Undang No. 11 Tahun 2020 Tentang Cipta Kerja. Metode penelitian yang digunakan dalam penulisan artikel ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan perbandingan hukum. Hasil Penelitian Hak Pakai diatas tanah HPL dapat diberikan perpanjangan sekaligus serta kewenangan pembatalan peraturan daerah melalui peraturan presiden yang secara tidak langsung telah melanggar konstitusional terhadap kewajiban Negara serta Pemerintah atas sumber Agraria di Tanah-Air agar dikelola sebesar-besarnya untuk kemakmuran rakyat melalui prinsip corak demokrasi Ekonomi Indonesia, dalam bentuk badan usaha atau koperasi dengan spirit gotong royong. dikarenakan pengaturan sedikit tidaknya tidak mengacu pada prinsip ini. disamping itu juga terdapat pelanggaran motif dalam spekulasi monopoli bank tanah, Untuk menampung, mengelola dan melakukan transaksi jual-beli tanah-tanah Negara dibentuk lembaga Bank Tanah (BT). BT mengelola tanah-tanah klaim negara hasil penerapan domein verklaring di atas, dan kemudian ditetapkan sebagai aset Bank Tanah dalam bentuk HPL. Meski disebut diklaim sebagai lembaga non-profit, faktanya sumber pendanaannya dapat berasal pihak ke tiga termasuk, hutang-hutang lembaga asing. sehingga hal ini memberi wewenang keleluasan atas batas kewenangan negara melalui praktik benturan kepentingan melanggar unsur-unsur ketentuan dari pemberian hak pengelolaan.


This article was written with the aim of knowing the arrangement of land management rights and to find out and the problems that may arise related to the regulation of land management rights after the enactment of Law no. 11 of 2020 concerning Job Creation. The research method used in writing this article is a normative legal research method with a statutory approach and a comparative law approach. The results of the Right to Use Research on HPL land can be given an extension at the same time as well as the authority to cancel regional regulations through presidential regulations which have indirectly violated the constitutional obligations of the State and Government over agrarian resources in the country so that they are managed as much as possible for the prosperity of the people through the principle of a democratic style. Indonesian economy, in the form of business entities or cooperatives with the spirit of mutual cooperation. because the setting at least does not refer to this principle. In addition, there is also a violation of motives in the monopoly speculation of the land bank. To accommodate, manage and carry out transactions for buying and selling state lands, the Land Bank (BT) institution was formed. BT manages the lands claimed by the state resulting from the implementation of the domain verklaring above, and then they are designated as assets of the Land Bank in the form of HPL. Even though it is claimed to be a non-profit institution, in fact the source of funding can come from third parties, including debts from foreign institutions. so that this gives the authority flexibility over the limits of state authority through the practice of conflicts of interest violating the elements of the provisions of the granting of management rights.
