PENERAPAN PERATURAN KEBIRI KIMIA BAGI PELAKU KEKERASAN SEKSUAL TERHADAP ANAK

Abstract

Penelitian ini bertujuan guna  melakukan pengkajian hukum atas penerapan Peraturan Pemerintah Nomor 70 Tahun 2020 terkait hukuman kebiri kimia bagi pelaku kekerasan seksual terhadap anak. Metode penelitian yang dipakai dalam pembuatan jurnal ini yaitu dengan menggunakan metode yuridis normatif, penelitian yang difokuskan untuk mengkaji kaidah-kaidah atau norma yang terdapat dalam hukum positif. Berdasarkan hasil penelitian, penerapan peraturan ini ditujukan untuk memberi keadilan bagi korban, menekan angka pertumbuhan kasus, serta untuk memberikan efek jera bagi pelaku, alasan-alasan tersebut dikaitkan dengan teori-teori dalam hukum pidana yakni, teori retributif, teori deterrence, teori rehabilitasi, dan teori resosialisasi. Hukum Hak Asasi Manusia memandang bahwa hukuman ini merupakan bentuk pelanggaran hak asasi manusia, sebagaimana yang telah diatur dalam Deklarasi Universal Hak Asasi Manusia dan Undang-Undang No. 39 Tahun 1999 tentang Hak Asasi Manusia. Beberapa negara yang telah menerapkan hukuman ini yakni Denmark, Swedia, Finlandia, Norwegia, Polandia, Negara bagian AS California, Australia, Selandia Baru, Russia, Korea Selatan, Israel, Estonia, dan Moldova, pada dasarnya negara-negara yang telah menerapkan hukuman ini memiliki dua dasar tujuan, pertama menerapkan hukuman ini sebagai hukuman nasional, dan kedua menerapkan hukuman ini secara sukarela dari pelaku.


This research was conducted with the aim of examining the law on the application of Government Regulation Number 70 of 2020 regarding chemical castration punishment for perpetrators of sexual violance against children. The research method used in the making of this journal is to use the normative juridicial method, research that is focused on studying the norms contained ini positive law. Based on the results of the research, the application of this regulation is intended to provide justice for victims, reduce the growth rate of cases of sexual violance against children, and to provide a deterrent effect for the perpetrators, these reasons are linked to theories in criminal law, such as retributive theory, deterrence theory, rehabilitation theory, and resocialization theory. Human Rights Law considers that the chemical castration law is a form of human rights violation, as stipulated in the Universal Declaration Of Human Rights and Law No. 39 of 1999 concerning Human Rights. Countries have implemented chemical castration laws are Denmark, Swedia, Finlandia, Norwegia, Polandia, The US state of California, Australia, New Zealad, Russia, South Korea, Israel, Estonia, and Moldova, basically the countries that have implemented this law have two basic goals, firstly implementing this punishment as a national punishment, and secondly implmenting this law voluntarily from the perpetrator
