PENDELEGASIAN SEBAGIAN WEWENANG GUBERNUR KEPADA SEKRETARIS DAERAH DALAM PENANDATANGANAN KEPUTUSAN GUBERNUR

Abstract

Tujuan penelitian ini adalah untuk dapat mengetahui wewenang yang dapat didelegasikan oleh Gubernur kepada Sekretaris Daerah. Adapun metode yang dipakai adalah  yuridis normatif dengan demikian bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, bahan hukum sekunder dan bahan-bahan non hokum. Berdasarkan hasil pembahasan  di hasilkan sebagai berikut (1) Gubernur dapat mendelegasikan wewenang-wewenangnya untuk menjalankan kedua perannya itu kepada Sekretaris Daerah, sepanjang diatur dalam peraturan perundang-undangan, (2) dalam setiap jabatan pasti melekat juga tugas, wewenang dan tanggungjawab oleh karena itu, setiap pejabat harus bertanggungjawab dengan tugas dan wewenangnya. Begitu pula dalam pendelegasian wewenang. Pendelegasian wewenang Gubernur kepada Sekretaris Daerah dalam hal penandatanganan Keputusan Gubernur sudah seharusnya tanggung gugat beralih sepenuhnya kepada Sekretaris Daerah, karena arti pendelegasian itu sendiri adalah pelimpahan wewenang dari Badan dan atau pejabat pemerintahan yang lebih tinggi kepada Badan dan atau Pejabat Pemerintahan yang lebih rendah dengan tanggungjawab dan tanggung gugat beralih sepenuhnya kepada penerima delegasi.

The objective of this study is to be able to find out the authority that can be delegated by the Governor to the Regional Secretary. This study employed  normative juridical which the legal materials used in this study are primary legal materials, secondary legal materials and non-legal materials. The results indicated that  (1) Governor can delegate his authority to carry out his two roles to the Regional Secretary, as long as it is regulated in statutory regulations, (2) in each position there must also be inherent duties, authorities and responsibilities. Each official must be responsible for his duties and authority. Delegation of the Governor's authority to the Regional Secretary regarding the signing of the Governor's Decree should have been the responsibility of transferring fully to the Regional Secretariat, because the meaning of the delegation itself is the delegation of authority from the Agency and or higher government officials to the Agency and or Government Official which has lower responsibilities compared to the prior one and also  the claim responsibilities is fully transferred to the recipient of the delegation.
