URGENSI REGULASI “BAN THE BOX” DAN OPTIMALISASI PERAN PAROLE OFFICER
Abstract
Penelitian ini bertujuan untuk menganalisis kesesuaian penggunaan Surat Keterangan Catatan Kepolisian (SKCK) terhadap mantan narapidana dengan prinsip Hak Asasi Manusia, serta mengkaji potensi penerapan kebijakan Ban The Box dan optimalisasi peran parole officer dalam proses reintegrasi sosial. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan komparatif, menganalisis peraturan nasional, instrumen HAM internasional, serta praktik di negara lain yang telah mengadopsi kebijakan serupa. Hasil penelitian menunjukkan bahwa kewajiban melampirkan SKCK pada tahap awal rekrutmen berpotensi menimbulkan diskriminasi dan memperkuat stigma negatif terhadap mantan narapidana, sehingga menghambat akses mereka terhadap pekerjaan yang layak. Model kebijakan yang menempatkan pemeriksaan latar belakang pada tahap pasca-diterima kerja, sebagaimana dalam Ban The Box, dinilai lebih adil karena memberikan kesempatan bagi mantan narapidana untuk dinilai berdasarkan kompetensi dan kinerjanya. Peran parole officer terbukti penting dalam mengawasi, membimbing, dan menjembatani mantan narapidana dengan dunia kerja, sehingga dapat mengurangi risiko residivisme. Pendekatan ini tidak hanya melindungi hak atas pekerjaan tanpa diskriminasi, tetapi juga menjaga keamanan dan kepercayaan publik melalui pengawasan yang terstruktur.
This study aims to analyze the compatibility of requiring a Police Clearance Certificate (SKCK) for former convicts with the principles of Human Rights, as well as to examine the potential implementation of the Ban The Box policy and the optimization of parole officers’ roles in the reintegration process. The research employed a normative juridical method with statutory and comparative approaches, analyzing national regulations, international human rights instruments, and practices in countries that have adopted similar policies. The findings indicate that requiring SKCK at the initial stage of recruitment may lead to discrimination and reinforce negative stigma against former convicts, thereby hindering their access to decent employment. A policy model that places background checks at the post-hiring stage, as applied in Ban The Box, is considered fairer as it allows former convicts to be assessed based on their competence and performance. The role of parole officers is crucial in supervising, guiding, and connecting former convicts to the labor market, thus reducing the risk of recidivism. This approach not only protects the right to work without discrimination but also maintains public safety and trust through structured oversight.
