URGENSI PENGATURAN TANAH VIRTUAL METAVERSE SEBAGAI ASET INVESTASI DALAM MEMBERIKAN PERLINDUNGAN HAK INVESTOR DI INDONESIA

Abstract

Tujuan studi ini untuk mengkaji keberadaan tanah virtual sebagai aset digital belum diakui secara tegas dalam hukum Indonesia, menyisakan kekosongan normatif dan potensi ketidakpastian hukum. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan, konseptual dan komparatif. Hasil studi menunjukkan bahwa Pengaturan tanah virtual metaverse sebagai aset investasi belum sepenuhnya memberikan kerangka hukum yang jelas dan menjawab kebutuhan spesifik terkait tanah virtual. Urgensi perlindungan hak investor pemilik tanah virtual metaverse sebagai aset investasi di Indonesia masih terbatas dan tidak memberikan kepastian hukum yang memadai. Negara-negara seperti Inggris, Dubai, dan Korea Selatan yang telah mengembangkan kerangka hukum yang lebih jelas dan komprehensif untuk melindungi investor dalam konteks aset digital.

ABSTRACT 

The purpose of this study is to examine the existence of virtual land as a digital asset that has not been explicitly recognized in Indonesian law, leaving normative space and potential for legal violations. This study uses a normative legal research method with a regulator, conseptual and comparative approach. The results of the study indicate that the regulation of virtual metaverse land as an investment asset has not fully provided a clear legal framework and answered specific needs related to virtual land. The urgency of protecting the rights of investors who own virtual metaverse land as an investment asset in Indonesia is still limited and does not provide adequate legal certainty. Countries such as the UK, Dubai, and South Korea have developed a clearer and more comprehensive legal framework to protect investors in the context of digital assets.
