AKIBAT HUKUM TERHADAP PENGGUNA JASA NOTARIS YANG MENOLAK MENGISI CLIENT DUE DILIGENCE

Abstract

Artikel ini disusun guna mengetahui akibat hukum terhadap pengguna jasa notaris yang menolak mengisi client due diligence. Guna mencapai tujuan tersebut, artikel ini disusun dengan metode penelitian hukum normatif melalui pendekatan perundang-undangan serta pendekatan konseptual. Analisis atas bahan hukum pada penelitian ini menggunakan teknik preskriptif analitis. Berdasarkan penelitian ini dapat disimpulkan bahwa Notaris merupakan pihak yang dapat menjadi pelapor atas kemungkinan terjadinya TPPU. Prinsip mengenali jasa yang dilakukan oleh notaris setidaknya memuat identifikasi, verifikasi, dan pemantauan pengguna jasa. Bilamana notaris dihadapkan ada pengguna jasanya menolak mentaati prinsip mengenali pengguna jasanya serta notaris memiliki keraguan atas keterangan pengguna jasa yang diberikan, maka notaris diwajibkan melakukan pemutusan hubungan usaha dengan pengguna jasa tersebut. Notaris yang tidak melakukan pemutusan hubungan usaha dengan pengguna jasa yang menolak melaksanakan CDD dapat dikenakan sanksi administratif.

ABSTRACT

This article was prepared to determine the legal consequences for notary service users who refuse to complete client due diligence. To achieve this goal, this article was prepared using normative legal research methods through a conceptual approach and a legislative approach. Legal materials were analyzed in this research using prescriptive analytical techniques. Based on this research, it can be concluded that the Notary is one of the parties who can become a reporter regarding the possibility of TPPU occurring. The principle of recognizing services provided by notaries at least includes identification, verification, and monitoring of service users. If a notary is faced with a service user who refuses to comply with the principle of recognizing service users and the notary has doubts about the information submitted by the service user. The notary is obliged to terminate the business relationship with the service user. Notaries who do not terminate business relations with service users who refuse to carry out CDD may be subject to administrative sanctions.
