PERAN DAN PERLINDUNGAN HUKUM TERHADAP SAKSI AKTA DALAM PEMBUATAN AKTA NOTARIS

Abstract

Tujuan penulisan ini adalah untuk mengetahui bagaimana sebenarnya undang-undang mengatur tentang peran dan kewajiban seorang saksi akta Notaris dalam pembuatan akta serta perlindungan hukum terhadap saksi akta Notaris yang terlibat dalam pembuatan akta Notaris tersebut. Jenis penelitian hukum normatif digunakan dalam penelitian ini, dengan meneliti norma, asas dan doktrin hukum yang terkait dengan peran, kewajiban dan perlindungan hukum terhadap saksi akta.  Hasil penulisan ini menunjukkan bahwa Undang-undang Jabatan Notaris mengatur tentang syarat-syarat adanya saksi akta dalam proses pembuatan akta, tetapi tidak mengatur tentang kewajiban saksi akta untuk merahasiakan isi akta dan perlindungan hukum terhadap saksi akta. Diperlukan pembaharuan pengaturan terhadap kewajiban dan perlindungan terhadap saksi akta Notaris.

ABSTRACT

The purpose of this paper is to find out how the law regulates the role and obligations of a notarial deed witness in the drafting of a notarial deed, as well as the legal protection afforded to the notarial deed witness involved in the preparation of such a deed. The type of research used in this journal is normative legal research by examining the norms, principles, and legal doctrines related to the role, obligations, and legal protection of notarial deed witnesses. The findings of this paper reveal that the Law on Notary Office stipulates the requirements for the presence of witnesses in the process of drafting a notarial deed, but does not address the obligation of witnesses to maintain the confidentiality of the deed’s contents, nor does it provide legal protection for witnesses. Therefore, regulatory reforms concerning the obligations and legal protection of notarial deed witnesses are necessary.
