PERLINDUNGAN HUKUM BAGI PEMILIK RUMAH SUSUN YANG UNITNYA DIBONGKAR KARENA KONDISI TIDAK BISA DIHUNI

Abstract

Penelitian ini bertujuan untuk mengkaji perlindungan hukum yang diberikan kepada pemilik unit rumah susun ketika unit mereka harus dibongkar karena kondisi yang tidak memungkinkan untuk dihuni. Rumah susun telah menjadi salah satu solusi perumahan yang penting di daerah perkotaan yang padat, dan pemilik unit rumah susun menghadapi risiko ketika kondisi bangunan mereka menjadi tidak layak huni. Penelitian ini menggunakan metode penelitian hukum normatif dengan mengumpulkan dan menganalisis berbagai peraturan hukum, putusan pengadilan, dan dokumen-dokumen terkait. Hasil analisis menunjukkan bahwa pemilik unit rumah susun memiliki hak-hak yang dilindungi oleh undang-undang dan peraturan yang berlaku. Namun, implementasi perlindungan hukum ini masih menghadapi tantangan, seperti lambatnya proses hukum dan kurangnya pemenuhan tanggung jawab dari pihak-pihak terkait. Penelitian ini juga mengidentifikasi beberapa solusi untuk meningkatkan perlindungan hukum bagi pemilik unit rumah susun yang unitnya dibongkar. Antara lain, perlu adanya pembaruan regulasi yang lebih jelas dan komprehensif, peningkatan akses ke mekanisme penyelesaian sengketa yang efektif, serta peningkatan pemahaman dan kesadaran pemilik unit rumah susun tentang hak-hak mereka.

This study aims to examine the legal protection given to owners of flats when their unit has to be demolished due to conditions that make it impossible to live in. Flats have become one of the most important housing solutions in dense urban areas, and owners of flats face risks when their building conditions become uninhabitable. This study uses a normative legal research method by collecting and analyzing various legal regulations, court decisions, and related documents. The results of the analysis show that the owners of flats have rights that are protected by applicable laws and regulations. However, the implementation of this legal protection still faces challenges, such as the slow legal process and the lack of fulfillment of the responsibilities of related parties. This research also identifies several solutions to increase legal protection for the owners of apartment units whose units are demolished. Among other things, it is necessary to reform regulations that are clearer and more comprehensive, increase access to effective dispute resolution mechanisms, and increase the understanding and awareness of apartment unit owners about their rights.
