EKSISTENSI FAN ART: KARYA CIPTA DERIVATIF YANG DILINDUNGI DAN POTENSINYA TERHADAP TERLANGGARNYA HAK-HAK PENCIPTA ASLI

Abstract

Tujuan penelitian ini bertujuan untuk mengkaji kepastian hukum pada pengaturan hukum fan art sebagai salah satu karya cipta derivative dalam perspektif UU HC serta potensinya terhadap terlanggarnya hak moral dan ekonomi pencipta dari karya yang dialihwujudkan. Metode yang digunakan dalam penelitian hukum ini adalah hukum normatif yang menggunakan statute approach, historical approach dan comparative approach. Hasil penelitian menunjukkan bahwa keberadaan fan art dalam perspektif UU HC dapat menjadi salah satu karya cipta adaptasi yang dilindungi sepanjang memenuhi karakteristik dari ciptaan adaptasi yang ditentukan dalam UU HC. Kemudian terkait adanya potensi pelanggaran dari keberadaan fan art yang diciptakan terhadap hak moral dan ekonomi pencipta yang karyanya dialihwujudkan dapat terjadi bilamana fan art diciptakan tanpa mencantumkan nama pencipta karya yang dialihwujudkan dan didasarkan dengan tujuan komersial tanpa disertai persetujuan atau izin secara tertulis (lisensi) dari pencipta yang karya dialihwujudkan terlebih dahulu.

The purpose of this study aims to examine legal certainty in the regulation of fan art law as a derivative copyright work in the perspective of the HC Law and its potential for violating the moral and economic rights of the creators of the converted works. The method used in this legal research is normative law which uses a statute approach, historical approach and comparative approach. The results of the study show that the existence of fan art in the perspective of the HC Law can be one of the adaptation copyrighted works that is protected as long as it fulfills the characteristics of the adapted creation specified in the HC Law. Then, in connection with the potential violation of the existence of fan art that is created against the moral and economic rights of the creator whose work is converted, it can occur if the fan art is created without including the name of the creator of the work being converted and is based on commercial purposes without written consent or permission (license) from the creator which works are translated.
