PERLINDUNGAN HUKUM TERHADAP ANAK KORBAN KEKERASAN SEKSUAL DI INDONESIA

Abstract

Penelitian ini bertujuan untuk menganalisis pengaturan perlindungan hukum bagi anak korban kekerasan seksual di Indonesia serta mengidentifikasi faktor-faktor yang menghambat optimalisasi perlindungan tersebut. Metode yang digunakan adalah penelitian normatif dengan pendekatan deskriptif-analitis melalui studi literatur terhadap regulasi seperti Undang-Undang Perlindungan Anak (UU Perlindungan Anak) No. 23 Tahun 2002, KUHP, UU PKDRT, dan UU TPKS. Hasil penelitian menunjukkan bahwa meskipun UU Perlindungan Anak telah mengatur hak korban, seperti bantuan hukum, perlindungan, dan rehabilitasi, implementasi perlindungan masih terhambat oleh ketidakharmonisan regulasi, termasuk tumpang tindih dan kontradiksi antar undang-undang terkait definisi serta sanksi dalam kasus kekerasan seksual terhadap anak.

This study aims to analyze the legal protection regulations for child victims of sexual violence in Indonesia and identify the factors that hinder the optimization of such protection. The research employs a normative approach with descriptive-analytical methods, conducting a literature review on regulations such as the Child Protection Act (UU Perlindungan Anak) No. 23 of 2002, the Indonesian Penal Code (KUHP), the Domestic Violence Act (UU PKDRT), and the Sexual Violence Crime Act (UU TPKS). The findings indicate that although the UU Perlindungan Anak outlines victims' rights, including legal assistance, protection, and rehabilitation, the implementation of these protections remains hindered by regulatory disharmony, overlaps, and contradictions between laws concerning definitions and sanctions for sexual violence against children.
