HUKUM TERKAIT PERLINDUNGAN HAK ATAS MEREK PADA PENJUALAN BARANG BERMEREK PALSU DI INDONESIA

Abstract

Tujuan dari penulisan ini untuk menelaah peraturan hukum yang berkaitan dengan pelestarian hak merek dan sanksi bagi penjual produk bermerek palsu. Penulisan memakai metode Penelitian Hukum Normatif, dengan pendekatan memakai Pendekatan Undang-Undang, Pendekatan Konseptual, dan Pendekatan analisis. Berdasarkan hasil penulisan, peraturan hukum terkait produk bermerek di Indonesia diatur di tingkat nasional melalui UU No 20 Thn 2016 terkait Indikasi Geografis dan Merek. Tindakan yang berkaitan dengan merek dagang ditetapkan oleh negara guna memberi perlindungan hukum pada pemilik merek. Pengaturan mengenai sanksi dikenakan kepada penjual produk merek palsu dapat dilihat pada Pasal 102 UU 20 Thn 2016 terkait Indikasi Geografis dan Merek.

The motivation behind composing this Exploration to survey Lawful Guidelines for Marked Products connected with the Assurance of Brand Right and approval for vendors of fake Marked Merchandise.The analysis utilizes normative legal research with the Statute Approach, Conceptual Approach, and Analytical Approach. The aftereffects of the Exploration express that the legitimate standards for Marked Merchandise in Indonesia have controlled Broadly in the Law of the Republic of Indonesia Number 20 of 2016 concern Brand and Geographic Indication. The State makes Regulations and Guidelines with respect to Imprints so that brand proprietors can be given Lawful Security. sanctions for sellers of fake Marked Products have been directed in article 102 the Law of the Republic Indonesia Number 20 of 2016.
