Pencatatan Akta Perjanjian Pengikatan Jual Beli Notariil Atas Tanah Terdaftar Pada Kantor Pertanahan
Abstrak
The purpose of this journal is to understand the arrangement of the PPJB Notarial Deed on registered land which is recorded at the Land Office and to formulate the precautionary principle into the PPJB Notarial deed on registered land which will be recorded at the Land Office. This study uses normative legal research with a statutory approach and a legal concept approach. The results of this study indicate that the PPJB Notarial Deed Arrangements for Registered Land that are recorded at the Land Office are contained in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia Number 16 of 2021 Third Amendment to the Regulation of the Minister of Agrarian Affairs/Head of the National Land Agency Number 3 of 1997 concerning Provisions for the Implementation of Government Regulation Number 24 of 1997 concerning Land Registration, the recording of a Notarial PPJB on land registered at the Land Office can only be made on a Notarial PPJB that has been paid off. The formulation of the precautionary principle into the PPJB Notarial deed for registered land which will be recorded at the Land Office can be seen in Article 127A Permen ATR Number 16 of 2021, which can be done by using an analogical argument by a Notary in applying the precautionary principle to the making of the PPJB Deed .
