PEMENUHAN HAK PENDIDIKAN SISWA SEKOLAH DASAR MASA PANDEMI COVID-19 DITINJAU DARI UNDANG-UNDANG PERLINDUNGAN ANAK
Abstract
Hak Pendidikan adalah salah satu hak anak yang harus dilindungi, perlindungan hak pendidikan anak dapatlah melalui pemenuhan pendidikan anak itu sendiri. Pada masa pandemi covid-19 pemerintah mengeluarkan kebijakan terkait pelaksanaan kegiatan belajar mengajar dari rumah atau yang disebut dengan pembelajaran daring. Dalam kegiatan belajar daring yang diciptakan oleh pemerintah ini menimbulkan suatu permasalahan terhadap hak-hak pendidikan anak. Oleh karena itu penelitian ini bertujuan untuk mengetahui sejauhmana Undang-Undang Perlindungan Anak dapat melindungi hak-hak anak khususnya hak pendidikan di lingkungan sekolah dasar yang ditinjau dari perspektif Undang-Undang Perlindungan Anak dan untuk mengetahui langkah apa yang telah ditempuh oleh pemerintah dalam melakukan pelaksanaan pemenuhan hak atas pendidikan siswa sekolah dasar pada masa pandemi covid-19. Adapun metode yang digunakan dalam melakukan penelitian ini adalah metode penelitian juridis normative dengan pendekatan konseptual dari berbagai doktrin dan pendapat ahli hukum terkait pemenuhan hak pendidikan anak di lingkungan sekolah dasar pada masa pandemi covid-19. Hasil dari penelitian ini adalah ditemukannya permasalahan berupa learning loss selama masa pandemi covid-19 sehingga pemerintah harus memberikan upaya-upaya untuk mengatasi learning loss tersebut seperti menetapkan pembelajaran tatap muka terbatas. Upaya yang dilakukan ini menuju pada tujuan negara yang diatur dalam Pembukaan UUD NRI 1945 Alinea Keempat yaitu mencerdaskan kehidupan bangsa.
ABSTRACT
The right to education is one of the children’s rights that must be protected, the protection of children’s education rights can be throught the fulfillment of the child’s education itself. Durng the covid-19 pandemic, the government issued a policy regarding the implementation of teaching and learning activities from home or what is known as online learning. In online learning activities created by the government, this raises a problem with rights of children’s education. Therefore, this study aims to determine to what extent the Child Protection Act can protect children’s rights, especially the right to education in elementary school environment from the perspective of the Child Protection Act and to find out what stas have been taken by government in implementing fulfillment of the rights to education of elementary school students during the civod-19 pandemic. The Method used in conducting this research is a normative juridical research mothod with a conceptual approach from various doctrine and legal expert opinions regarding the fulfillment of childern’seducational rights in the elementary school environment during the covid-19 pandemic. The result of this research is the finding of problems in the form of learning loss during the covid-19 pandemic, so government must provide efforts to overcome the learning loss, such as establishing limited face-to-face learning. These efforts are aimed at the state goal as regulated in the Preamble to the 1945 Constitution of the Republic of Indonesia, the fouth paragraph, namely to educate the life of nation.
