PENERBITAN SURAT KEPUTUSAN PENGAKHIRAN PENUGASAN PEGAWAI NEGERI SIPIL ATAS PERBUATAN TINDAK PIDANA
Abstract
Tujuan dilakukannya penelitian yaitu (1) guna mengetahui pengaturan penerbitan surat keputusan pengakhiran penugasan pegawai negei sipil atas perbuatan tindak pidana dan (2) untuk melakukan analisis hukum terkait penerbitan surat keputusan pengakhiran penugasan pegawai negeri sipil atas perbuatan tindak pidana terkait MA 68 K/TUN/2015. Kajian ini mempergunakan jenis penelitian hukum yang bersifat normative dengan memanfaatkan data-data sekunder yang diperoleh melalui data sekunder serta data primer. Hasil kajian pertama, penerbitan surat pengakhiran tugas pegawai negeri sipil diatur didalam pasal 87 ayat 4 UU no 5 tahun 2014 serta dalam pasal 18 Peraturan BKN (Badan Kepegawaian Nasioanl) no 3 tahun 2020. Kedua, sesuai dengan kasus putusan MA 68 K/TUN/2015 bahwa keputusan pengadilan menolak gugatan tergugat sudah benar, karena penggugat masuk kedalam kualifikasi melakukan perbuatan pidana dengan memanfaatkan jabatan.

ABSTRACT
The aims of the research are (1) to find out the arrangements for the issuance of decrees on terminating civil servants for criminal acts and (2) to carry out a legal analysis related to the issuance of decrees for ending assignments for civil servants for criminal acts related to MA 68 K/TUN /2015. This study uses a type of legal research that is normative by utilizing secondary data obtained through secondary data and primary data. The results of the first study, the issuance of a civil servant termination letter is regulated in article 87 paragraph 4 of Law No. 5 of 2014 and in Article 18 of BKN Regulation (National Personnel Agency) No. 3 of 2020. Second, in accordance with the case of the Supreme Court decision 68 K/TUN/ 2015 that the court's decision to reject the defendant's lawsuit was correct, because the plaintiff entered into the qualifications of committing a criminal act by utilizing his position.
