EFEKTIVITAS UNDANG-UNDANG NOMOR 11 TAHUN 2022 TENTANG KEOLAHRAGAAN TERHADAP PERKEMBANGAN OLAHRAGA ANGKAT BERAT DI INDONESIA

Abstract

Tujuan menyeluruh studi ini adalah untuk memastikan apakah Undang-Undang Nomor 11 Tahun 2022 tentang Keolahragaan di Indonesia telah membantu negara tersebut mencapai tujuannya menjadi kekuatan internasional dalam kompetisi gaya Olimpiade. Investigasi ini menggunakan gabungan dari analisis undang-undang dan metodologi berbasis tinjauan literatur dan teknik penelitian hukum normatif. Hasil penelitian menginformasikan ketentuan UU No. 11 Tahun 2022 tentang Keolahragaan yang berkaitan dengan pertumbuhan angkat berat sebagai cabang olahraga. Dengan adanya peraturan pelaksanaan yang menyertai UU Keolahragaan terkait dengan pembinaan olahraga angkat berat seperti pendanaan dan penyelenggaraan pekan dan kejuaraan olahraga, maka dapat ditarik kesimpulan bahwa UU Keolahragaan sudah cukup memenuhi hak asasi manusia. Kesimpulan tersebut dapat diambil karena peraturan pelaksanaan yang menyertai Undang-Undang Keolahragaan terkait dengan perkembangan olahraga angkat berat. Namun persoalannya, peran dan posisi sumber daya manusia yang berkecimpung di dunia olahraga seringkali saling bertentangan sehingga belum terealisasi dengan baik. Dapat ditarik kesimpulan bahwa Undang-Undang Keolahragaan tidak dapat diterapkan secara efektif pada pertumbuhan angkat berat sebagai olahraga sebagai akibatnya.

ABSTRACT

This study aims to ascertain whether or not Law No. 11 of 2022 on Powerlifting in Indonesia is helping the country achieve its goal of becoming an international powerhouse in Olympic-style powerlifting. This inquiry makes use of a combination of a normative legal research methodology and an approach based on statutory analysis and literature review. The research concludes that the provisions of Law Number 11 of 2022 Concerning Sports regarding the development of Powerlifting generate Rechtsorde. Since the Sports Law is accompanied by implementing regulations concerning the growth of powerlifting, including the provision of funding for and the organization of sports weeks and championships, it is reasonable to assume that the Sports Law adequately protects the human rights of its subjects. Powerlifting's rapid expansion is reflected in the Sports Law's corresponding implementing regulations, so this conclusion stands. However, it has not been fully realized because the different functions and positions of human resources in the sports industry frequently clash with one another. As a result, one might conclude that the Sports Law is ineffective when applied to the development of powerlifting as a sport.
