PERAN PEMERINTAH UNTUK MELINDUNGI PENGUNGSI LUAR NEGERI DI INDONESIA PADA MASA COVID-19

Abstract

Tulisan ini bertujuan untuk mengetahui apakah Indonesia memiliki kewajiban untuk melindungi para pengungsi luar negeri, walaupun Indonesia tidak menandatangani Konvensi pengungsi 1951 dan Protokolnya serta untuk mengetahui apakah yang pemerintah Indonesia sudah cukup membantu para pengungsi luar negeri untuk bertahan hidup semasa pandemic Covid-19. Tulisan ini menggunakan metode penelitian Normatif dengan pendekatan undang-undang dan pendekatan kasus. Indonesia memiliki kewajiban untuk melindungi para pengungsi walaupun Indonesia belum menandatangani Konvensi mengenai Status Pengungsi dan Protokolnya. Namun, Indonesia gagal menjamin hak-hak yang menjadi hak para pengungsi, terutama di tengah merebaknya wabah Covid-19, seperti misalnya di tempat penampungan pengungsi di Makassar telah ada yang dinyatakan Covid-19. Dengan kurangnya Upaya pemerintah Indonesia dalam menyediakan fasilitas Kesehatan dan standar perumahan yang memadai untuk para pengungsi, maka bisa ditemukan pengungsi yang dinyatakan positif Covid-19. Kata Kunci: Pengungsi, Covid-19, Perlindungan Pengungsi, Konvensi Pengungsi Luar Negeri, Hak Asasi Manusia. ABSTRACT This paper aims to find out whether Indonesia has responsibilities to look after refugees, despite the fact Indonesia did not sign the 1951 Refugee Convention and its Protocol and to find out whether the Indonesian government has been sufficient to help refugees to survive during the Covid-19 pandemic. This paper is using the normative research methods. Indonesia still responsible to look after refugees despite the fact that Indonesia hasn’t signed the Protocol and Convention of Refuges. Howbeit, Indonesia failed to guarantee the rights of refugees, especially in Covid-19 pandemic. At the refugee shelter in Makassar, someone has been declared Covid-19. With the lack of efforts by the Indonesian government in providing health facilities and adequate housing standards for the refugees, it is of course not surprising that someone has tested positive for Covid-19. Key Words: Refugees, Covid-19, Refugees Protection, Convention of Refugees, Human Rights.
