PERLINDUNGAN HUKUM TERHADAP ANAK DIBAWAH UMUR YANG MENJADI KORBAN KEKERASAN SEKSUAL

Penelitian ini bertujuan untuk menginvestigasi perlindungan hukum terhadap anak di bawah umur yang menjadi korban kekerasan seksual. Penelitian ini mengidentifikasi dua rumusan masalah, yaitu pengaturan hukum positif terkait perlindungan anak korban kekerasan seksual di Indonesia dan bentuk hukum yang dicita-citakan terkait bentuk perlindungan hukum yang ideal bagi anak korban kekerasan seksual. Metode penelitian yang digunakan adalah metode penelitian normatif yang menganalisis norma hukum yang berlaku dan prinsip-prinsip hukum terkait perlindungan anak korban kekerasan seksual. Penelitian ini menghadapi problematika dengan potensi terjadinya konflik norma dalam perlindungan hukum. Potensi konflik norma terjadi akibat pertentangan atau ketidaksesuaian antara norma-norma yang berlaku. Penelitian ini diharapkan dapat memberikan pemahaman yang lebih baik tentang perlindungan hukum terhadap anak korban kekerasan seksual dan faktor-faktor yang mempengaruhi sistem hukum dalam melaksanakan perlindungan tersebut. Selain itu, penelitian ini juga diharapkan dapat meningkatkan pemahaman dan tindakan dalam melindungi anak-anak korban kekerasan seksual serta menjaga hak-hak mereka dalam sistem hukum.

ABSTRACT
This research aims to investigate legal protection for minors who are victims of sexual violence. This research identifies two problem formulations, namely positive legal arrangements related to the protection of child victims of sexual violence in Indonesia and the desired form of law regarding the ideal form of legal protection for child victims of sexual violence. The research method used is a normative research method that analyzes applicable legal norms and legal principles related to the protection of child victims of sexual violence. This research faces problems with the potential for conflicting norms in legal protection. Potential norm conflicts occur due to contradictions or inconsistencies between applicable norms. It is hoped that this research can provide a better understanding of legal protection for child victims of sexual violence and the factors that influence the legal system in implementing this protection. Apart from that, it is also hoped that this research will increase understanding and action in protecting child victims of sexual violence and safeguarding their rights in the legal system.
