TUGAS DAN WEWENANG MAJELIS DESA ADAT DALAM PERATURAN DAERAH NOMOR 4 TAHUN 2019 TENTANG DESA ADAT DI BALI

Abstract

Tujuan penelitian ini yaitu untuk memahami tugas Majelis Desa Adat dengan Pemerintah Daerah Provinsi Bali dan memahami kedudukan Majelis Desa Adat dalam penyelenggaraan pemerintahan daerah Provinsi Bali. Jenis penelitian yang digunakan dalam penelitian ini yaitu jenis penelitian hukum normatif. Hasil penelitian ini bahwa tugas MDA sangat luas dan abstrak. Tugas tersebut diatur dalam Perda Desa Adat yang hanya memuat hubungan MDA dengan masyarakat adat di Bali saja. Sedangkan pengaturan wewenang MDA dalam Perda Desa Adat tidak termasuk dalam konsep kewenangan atribusi, delegasi dan mandat. Padahal dalam melakukan tindakan dan mengambil kebijakan, MDA membutuhkan dasar hukum yang kuat agar kebijakan yang diambil oleh MDA itu sah menurut hukum.

The purpose of this study is to understand the duties of the Traditional Village Council with the Bali Provincial Government and understand the position of the Traditional Village Council in the administration of the Bali Province regional government. The type of research used in this research is the type of normative legal research. The result of this research is that the MDA task is very broad and abstract. This task is regulated in the Customary Village Regulation which only contains the relationship between MDA and indigenous peoples in Bali. Meanwhile, the regulation of MDA authority in the Customary Village Regulation is not included in the concept of attribution, delegation and mandate authority. Whereas in taking action and making policies, MDA requires a strong legal basis so that the policies taken by MDA are legal according to law.
