TATA CARA PILKADA SERENTAK TAHUN 2020 SEBAGAI HAK KONSTITUSIONAL WARGA NEGARA

Penelitian ini bertujuan untuk menelaah Pilkada Serentak Tahun 2020 banyak menuai problematika bagi pemerintah maupun masyarakat. Hal ini disebabkan karena pandemi Covid-19 yang melanda sehingga tingkat partisipasi masyarakat dalam menggunakan hak pilihnya menjadi menurun. Wabah pandemi Covid-19 telah mengancam kesehatan masyarakat dan memberikan dampak terhadap agenda demokrasi di Indonesia. Oleh karena itu, penulis tertarik dalam melakukan penelitian, supaya mengetahui bagaimana hak pilih masyarakat dalam Pilkada Serentak Tahun 2020 sebagai pelaksanaan hak konstitusional warga negara. Pada penelitian ini digunakan metode penelitian yuridis empiris, sifat penelitiannya ialah deskriptif menggunakan sumber data sekunder berupa bahan hukum primer, sekunder dan tersier. Pengumpulan data dengan menggunakan studi kepustakaan yang dirangkum dalam analisis kualitatif. Jenis penelitian yang digunakan ialah penelitian hukum empiris. Hasil penelitian menunjukkan bahwa Pilkada Serentak Tahun 2020 mengantisipasi bahwa pelaksanaannya tidak dilakukan dalam keadaan yang normal, sehingga harus mempersiapkan pelaksanaan dengan mematuhi protokol kesehatan Covid-19. Dengan adanya Perppu No. 2 Tahun 2020 yang telah ditetapkan menjadi Undang-Undang No.6 Tahun 2020 telah memberikan kepastian hukum akan pelaksanaan Pilkada tahun 2020 saat pandemi Covid-19 itu artinya pemerintah menyokong pelaksanaan Pilkada langsung secara lazim, sehingga dapat diapresiasi bahwa pemerintah berusaha merealisasikan hak konstitusional warga negara dengan penyelenggaraan pilkada. Tetapi, hal yang bisa digaris bawahi adalah terwujudnya hak-hak berupa hak memilih, hak hidup, dan hak memperoleh kesehatan ialah hak asasi manusia (HAM). Untuk mencapai itu semua pemerintah harus menetapkan protokol kesehatan Covid-19 sesuai dengan UU Covid-19 atau secara tegas pada pelaksanaan Pilkada Serentak.

ABSTRACT
This study aims to examine the Simultaneous Regional Head Elections in 2020 that reap many problems for the government and the community. This is due to the Covid-19 pandemic that hit so that the level of public participation in exercising their voting rights has decreased. The COVID-19 pandemic has threatened public health and has had an impact on the democratic agenda in Indonesia. Therefore, the author is interested in conducting research, in order to find out how people's suffrage in the 2020 Simultaneous Regional Head Elections is the implementation of citizens' constitutional rights. In this study, empirical juridical research methods were used, the nature of the research was descriptive using secondary data sources in the form of primary, secondary and tertiary legal materials. Collecting data using a literature study which is summarized in a qualitative analysis. The type of research used is empirical legal research. The results of the study indicate that the 2020 Simultaneous Regional Head Elections anticipate that its implementation will not be carried out under normal circumstances, so it must prepare for implementation by complying with the Covid-19 health protocol. With the Perppu No. 2 of 2020 which has been stipulated as Law No. 6 of 2020 has provided legal certainty for the implementation of the 2020 Pilkada during the Covid-19 pandemic, which means that the government supports the implementation of direct elections in a normal way, so it can be appreciated that the government is trying to realize the constitutional rights of citizens. with holding elections. However, what can be underlined is that the realization of rights in the form of the right to vote, the right to life, and the right to health are human rights (HAM). To achieve this, all governments must establish a Covid-19 health protocol in accordance with the Covid-19 Law or explicitly on the implementation of Simultaneous Regional Head Elections.
