Pengaturan Hak Cipta Fotografi Dalam Perspektif Hukum Internasional dan Nasional (Studi Kasus Selfie yang Dilakukan Hewan)

Tujuan dalam penelitian ini yaitu untuk mengetahui bagaimana pengaturan pemegang hak cipta terkait karya fotografi selfie yang dilakukan oleh hewan dalam perspektif hukum Intersional dan Nasional serta mengetahui sanksi hukum penggunaan karya fotografi tanpa izin pemegang hak cipta. Hasil penelitian ini yaitu Pengaturan Hak Cipta yang di terapkan di Indonesia dengan di Amerika Serikat mengatur hal yang berbeda antara lain mengenai obyek yang di lindungi, hak eksklusif, serta jangka waktu perlindungan hak cipta. Hak cipta berlaku pada berbagai jenis karya seni atau karya cipta atau ciptaan. Berdasarkan Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yaitu pencipta sebagai pemilik hak cipta, pihak yang menerima hak tersebut secara sah dari pencipta, atau pihak lain yang menerima lebih lanjut hak dari pihak yang menerima hak tersebut secara sah. Sanksi hukum “Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta yang didapatkan terhadap pelanggaran karya cipta fotografi yang diambil tanpa izin di media sosial hanya dapat dipidana apabila pemegang hak karya cipta melaporkan tindakan orang yang menyebarkan karya ciptanya di media sosial kepada pihak berwajib” yang diatur dalam Pasal 113.

ABSTRACT

The purpose of this research is to know the regulation regarding copyright holders related to selfie photography works carried out by animals in the perspective of Intersional and National law and to find out the legal sanctions for the use of photographic works without the permission of the copyright holders. The result of this research is that the Copyright Arrangement which is applied in Indonesia and in the United States regulates different matters, among others, regarding protected objects, exclusive rights, and the period of copyright protection. Copyright applies to various types of works of art or works of copyright or creation. Based on Law Number 28 of 2014 concerning Copyright, namely the creator as the owner of the copyright, the party who receives the right legally from the creator, or other parties who receive further rights from the party legally accepting the right. Legal sanctions "Law Number 28 of 2014 concerning Copyright obtained against infringement of photographic copyrighted works that are taken without permission on social media can only be punished if the copyright owner reports the actions of the person who spreads his work on social media to the authorities" which regulated in Article 113.
