PENGALIHWUJUDAN NOVEL MENJADI FILM DALAM PERSPEKTIF HAK CIPTA

Abstract

Penelitian ini memiliki tujuan untuk melakukan pengkajian tentang pengalihwujudan novel menjadi film dalam perspektif hak cipta. Penelitian ini termasuk dalam penelitian normatif. Hasil dari penelitian menunjukkan bahwa adaptasi telah diakui sebagai salah satu ciptaan menurut Undang-Undang Hak Cipta dimana ini tercantum dalam Pasal 40 ayat (1) huruf n. Kemudian karya seni baik sebagai novel, film, maupun adaptasi tetap memiliki hak untuk mendapatkan perlindungan hukum sesuai dengan yang telah diatur dalam Undang-Undang Hak Cipta yaitu perlindungan dari perbuatan pelanggaran hak cipta, penyelesaian sengketa hingga pertanggungjawaban dari pihak yang telah melakukan perbuatan yang melanggar hak cipta.

This study aims to examine the transformation of the novel into a film in the perspective of copyright. This study is a normative legal study. The study shows that adaptation has been recognized as one of the creation according to the Copyright Law which is listed in Article 40 paragraph (1) letter n. Then the work of art whether as a novel, film, or adaptation still has the right to obtain legal protection in accordance with what has been set out in the Copyright Law, namely protection from copyright infringement, dispute resolution to accountability of the party who has violated.
