EKSISTENSI PROGRAM PENDAFTARAN TANAH SISTEMATIS LENGKAP (PTSL) KANTOR PERTANAHAN DI INDONESIA

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana pelaksanaan program pendaftaran tanah sistematis lengkap (PTSL) dan bagaimana kepastian hukum hak atas tanah melalui program pendaftaran tanah sistematis lengkap (PTSL) pada Kantor Pertanahan di Indonesia. Penelitian ini menggunakan metode kualitatif dengan metode penelitian hukum normatif yang menggabungkan pendekatan perundang-undangan dan pendekatan historis. Berdasarkan hasil penelitian, pelaksanaan pendaftaran tanah kebijakan melalui program PTSL sudah berjalan dengan baik namun belum optimal. Birokrasi dan prosedur yang harus dilewati juga sudah seharusnya dipermudah agar prosesnya pun tidak berbelit-belit. Biaya yang dikenakan pun sudah tergolong sangat murah yang diharapkan agar semua warga yang memiliki pendapatan menengah keatas maupun menengah kebawah agar memiliki serpikat tanah.

The purpose of this paper is to find out the implementation systematic land registration (PTSL) program and how legal certainty of land rights is provided through the complete systematic land registration (PTSL) at the Land Office in Indonesia. This research uses a qualitative method with a normative legal research method that combines a statutory approach and a historical approach. Based on the research results, the implementation of policy land registration through the PTSL program has gone well but is not yet optimal. The bureaucracy and procedures that must be passed should also be made easier so that the process is not complicated. The fees charged are also very cheap, which is expected so that all residents who have upper-middle and lower-middle incomes will own land certificates.
