KEWENANGAN PENGADILAN NIAGA TERKAIT PEMERIKSAAN KEBERATAN PUTUSAN KOMISI PENGAWASAN PERSAINGAN USAHA

Abstract

Studi ini bertujuan untuk mengetahui dan menganalisis terkai tuntuk mengetahui dan menganalisis terkait pengaturan pemeriksaan keberatan terhadap putusan KPPU pasca berlakunya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Serta untuk mengetahui dan menganalisis kewenangan Pengadilan Niaga pasca berlakunya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penulisan karya ilmiah ini menggunakan jenis penelitian normatif. Tulisan ini menggunakan pendekatan peraturan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach). Hasil studi menunjukkan bahwa Pengaturan pemeriksaan keberatan terhadap putusan KPPU pasca berlakunya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja Pasal 118 memuat perubahan terhadap Pasal 44, 45, 47, 48, dan 49 Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat. Kewenangan Pengadilan Niaga pasca berlakunya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja dalam mengatur pengajuan permohonan keberatan dan pemeriksaan atas putusan Komisi Pengawas Persaingan Usaha (KPPU) ke Pengadilan Niaga hingga kasasi di Mahkamah Agung (MA).

ABSTRACT

This study aims to find out and analyze related to knowing and analyzing the arrangements for examining objections to the KPPU's decision after the enactment of Law Number 11 of 2020 concerning Job Creation. And to find out and analyze the authority of the Commercial Court after the enactment of Law Number 11 of 2020 concerning Job Creation. The writing of this scientific paper uses the type of normative research. This paper uses a statutory approach and a conceptual approach. The results of the study show that the arrangement for examining objections to the KPPU's decision after the enactment of Law Number 11 of 2020 concerning Job Creation Article 118 contains amendments to Articles 44, 45, 47, 48, and 49 of Law Number 5 of 1999 concerning the Prohibition of Monopolistic Practices and Unfair competition. The authority of the Commercial Court after the enactment of Law Number 11 of 2020 concerning Job Creation in regulating the submission of objections and examinations of the decision of the Business Competition Supervisory Commission to the Commercial Court up to an appeal to the Supreme Court.
