ANALISIS PERTANGGUNGJAWABAN PIDANA PERUSAHAAN INDUK ATAS TINDAK PIDANA KORUPSI PERUSAHAAN ANAK

Abstract

Studi ini memiliki tujuan untuk mengetahui dan menganalisis hubungan antara perusahaan induk dan anak perusahaan, serta pertanggungjawbaan perusahaan induk terhadap tindak pidana korupsi perusahaan anak. Metode yang penulis digunakan adalah metode hukum normatif dengan didasarkan pada data sekunder. Penelitian ini menunjukan walaupun perusahaan induk dan perusahaan anak merupakan subyek hukum mandiri, tidak menyebabkan perusahaan induk bebas dari pertanggungjawabannya. Perbuatan perusahaan anak yang dilakukan atas instruksi perusahaan induk dapat dikatakan sebagai perbuatan perusahaan induk ketika dilakukan dalam lingkup kerja perusahaan. Hal tersebut merujuk kepada ketentuan pasal 6 PERMA 13/2016.

ABSTRACT


 


This study had a purpose to find out how the parent company responsible for the criminal acts of corruption in subsidiary companies. The method that the author uses is a normative legal method based on secondary data. This study shows that although the parent company and subsidiary company are independent legal subjects, it does not mean that the parent company cannot be held responsible. The actions of the subsidiary company carried out on the instructions of the parent company can be said to be the actions of the parent company when carried out within the scope of work of the company. This refers to the provisions of Article 6 PERMA 13/2016.
