Perlindungan Karya Cipta Podcast Audio Berdasarkan Undang-Undang Hak Cipta Tahun 2014

Tujuan penelitian ini adalah untuk menganalisis pengaturan dalam melindungi karya cipta podcast audio berdasarkan Undang-Undang Hak Cipta dan mengetahui sanksi hukum apabila terjadi tindakan pembajakan seperti mengunggah ulang karya podcast audio oleh pihak lain tanpa izin podcaster. Penulisan ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan analisis konsep hukum. Hasil analisis menunjukkan bahwa podcast audio dengan topik bahasan seperti ceramah, kuliah, pidato maupun ciptaan sejenis lainnya telah diatur dalam Pasal 40 ayat (1) huruf b UUHC, sedangkan diluar dari jenis topik tersebut belum diatur sehingga terjadi kekaburan norma perihal tidak adanya penjelasan lebih lanjut terkait frasa “ciptaan sejenis lainnya”. Atas tindakan mengunggah ulang podcast audio oleh pihak lain dengan tujuan komersial secara tidak sah, dapat dikenakan sanksi sebagaimana diatur dalam UUHC dengan jalan melakukan pengaduan maupun mengajukan gugatan ganti rugi.

ABSTRACT
The purpose of this research is to analyze the arrangements in protecting the copyrighted work of audio podcasts under the copyright act and to know the legal sanctions in the event of piracy such as re-uploading audio podcasts work by other parties without the permission of podcasters. This writing uses normative legal research methods with a statutory approach and analysis of legal concepts. The results of the analysis showed that audio podcasts with a subject topic such as sermons, lecturers, addresses, or other works of utterance have been set out in Article 40 paragraph (1) letter b of the Copyright Act, while outside of these types of topics have not been regulated so that there is a blurring of norms regarding the absence of further explanation related to the phrase “other works of utterance”. For the act of unlawfully re-uploading audio podcasts by others for commercial purposes may be penalized as stipulated in the copyright Act by making a complaint of filing a claim for demages.
