Analisis Yuridis Penetapan Kabupaten Bangli Sebagai Kawasan Konservasi Dalam Perda Tata Ruang Provinsi Bali

Penelitian ini bertujuan untuk mengkaji dan menganalisis terkait penetapan Kabupaten Bangli sebagai kawasan konservasi dan kawasan strategis pariwisata daerah khusus, khususnya dalam hal ini adalah kawasan penyangga air bersih di Provinsi Bali dan juga menganalisis bagaimana kontribusi pemda lain untuk mendukung pembangunan Kabupaten Bangli sebagai kawasan konservasi. Metode dalam penelitian ini yaitu metode penelitian yuridis normatif dengan menggunakan pendekatan peraturan perundang-undangan. Kesimpulan daripada penelitian ini adalah Bali yang mengandalkan sektor pariwisata terutama pajak hotel maupun restoran sebagai pendapatan asli daerah, namun akomodasi wisata berupa hotel maupun restoran tersebut tersebar tidak merata di Bali, apalagi Kabupaten Bangli yang pembangunannya sangat terbatas dengan tujuan untuk melindungi kawasan konservasi sehingga penerimaan pajak hotel maupun restoran di Kabupaten Bangli tergolong rendah dibanding Kabupaten lain di Bali. Kontribusi dari kabupaten/kota lainnya di Bali yang menikmati manfaat dari kawasan konservasi untuk pembangunan Kabupaten Bangli sangat diperlukan, dalam hal ini berupa hibah bagi hasil Pajak Hotel maupun Restoran serta perlunya Pemerintah Provinsi Bali memberikan Dana Insentif Kompensasi. Tetapi hingga saat ini belum ada peraturan yang mengatur tentang pemberian insentif ini, sehingga perlu dibentuk suatu regulasi yang mengatur pemberian insentif ini.

ABSTRACT

This study aims to examine and analyze designation of the Bangli Regency as a conservation area and a strategic area for tourism in a special area, especially in this case, a buffer zone for clean water in the Province of Bali and also analyze how other local governments contribute to supporting the development of the Bangli Regency as a conservation area. Method in this research is used normative juridical research method with use of the regulatory approximation of legislation. The conclusion of this study is that Bali relies on the tourism sector, especially hotel and restaurant taxes as local revenue, but tourism accommodations in the form of hotels and restaurants are spread unevenly in Bali, especially Bangli Regency whose construction is very limited with the aim to protect the conservation area so that tax revenue hotels and restaurants in Bangli Regency are classified as low compared to other Regencies in Bali. Contributions from other regencies / cities in Bali that enjoy the benefits of conservation areas for the development of Bangli Regency are very much needed, in this case in the form of grants for hotel and restaurant tax revenue and the need for the Provincial Government of Bali to provide Compensation Incentive Funds. But until now there is no regulation that governs the provision of these incentives, so it is necessary to establish a regulation that regulate the provision of these incentives.
